18.01.2022 Estate litigation takes many forms. This is a very interesting case, most likely based in equitable estoppel. Our guess is that the judgement will go something like this: the deceased made a promise to the neighbours (leaving the properties to them) the neighbours acted according to the agreement (not blocking the views and looking after the deceased for the rest of her life), the neighbours acted in accordance with and in reliance of the agreement, the deceased did not, and the court therefore enforced the promise. Hows that for an explanation of a VERY complex area of the law in under 60 words!!!!! The judgement will make for an interesting read.....
