24.01.2022 NEW FREE BUSHFIRE LEGAL HELP TACKLES EMERGING PROBLEMS After dealing with the initial impact of a natural disaster, it can often take months for bushfire victims to turn their attention to legal issues some of which take considerable time to emerge. Bushfire legal issues can include:... Insurance claim disputes Property and stock losses Landlord and tenancy matters Fencing and boundary problems Debt and income difficulties Employment law protections for workers assisting with bushfire management measures Centrelink benefits and financial hardship options for individuals and small businesses Replacing destroyed documents (e.g. Insurance paperwork, tenancy agreements, drivers’ licences, property documents, Medicare cards, and certificates relating to birth, death, marriage or a change of name) With funding from the Commonwealth, the SA government is putting lawyers on the ground to provide free assistance to individuals, small businesses and primary producers affected by last summer’s fires. This assistance is not means tested and is provided by us and Community Legal Centres South Australia. Our lawyers are now providing free legal advice, information and assistance to bushfire victims in the regions outlined below. 22.01.2022 Declared Public Precincts If you're out celebrating this New Year’s Eve, remember that special laws apply in two particular entertainment areas in metropolitan Adelaide. These areas are known as declared public precincts, and police have increased powers within these zones during the New Year’s celebrations (6:00pm-6:00am). ... Such powers include police officers having the power to carry out metal detector and general drug detection searches in declared public precincts. Failure to comply with police requirements and directions in relation to these powers is an offence. The first precinct covers the Adelaide City West area, within the boundaries of: Northern boundary of North Terrace to western boundary of West Terrace; and Western boundary of West Terrace to southern boundary of Currie Street; and Southern boundary of Currie Street to eastern boundary of King William Street; and Eastern boundary of King William Street to northern boundary of North Terrace. The second precinct covers Glenelg, within the boundaries of: Southern boundary of Pier Street taking a straight line west to the low tide of the Gulf St. Vincent Low tide of the Gulf St. Vincent (western edge) to the northern boundary of Chappell Drive and Anzac Highway, including the Holdfast Shores Promenade Northern boundary of Anzac Highway extending to Chappell Drive to eastern boundary of Brighton Road Eastern boundary of Brighton Road to southern boundary of Pier Street Tram Stop 15; including the northern boundary of Dunbar Terrace to Service Road, south across the tram tracks 40 metres east of Brighton Road, to the southern side of Maxwell Terrace up to the intersection with Fortrose Street. 22.01.2022 Noisy Neighbours? Noise from neighbours is a common source of nuisance, and for some people can be very upsetting. The main complaints relate to barking dogs, parties, loud music and cars. If your neighbours disturb you with unreasonable amounts of noise, it is a good idea to let them know that it is disturbing you. Try to be friendly and polite even if you are very annoyed about their behaviour. Your neighbour may not even be aware that the noise they are making could be dis...turbing you. If the problem continues, you could try writing them a letter. Legal action should only be used as a last resort as it tends to make relations between neighbours worse in the future. It is best to try to sort out issues with your neighbour directly or with the help of a mediator. Complaints about noisy parties should be reported to police as they have wide powers to stop excessive noise. For barking dogs or other animals, contact your local council. During the Fire Danger Season, restrictions are placed on lighting fires to reduce the chances of large fires starting. These restrictions are escalated when a Total Fire Ban Day is declared.... 10.01.2022 Breath testing and the law Police officers must be in uniform when exercising their random breath testing powers- which includes requiring a driver of a motor vehicle to undertake an alcotest, or drug screening test. All police vehicles are equipped to do breath testing and you can be breath tested at any time you are on the road.... Police have broad powers to stop and breath test any driver, including a qualified driver supervising the holder of a learner’s permit. Police can give on-the-spot licence disqualifications for exceeding a Prescribed Concentration of Alcohol of 0.08 or over, or for refusing a breath test, drug test, or blood test. Personal hardship or loss of employment are not grounds for keeping your licence. You cannot get a restricted licence or a licence just for work purposes.
