25.01.2022 A debt action ‘founded on contract’ cannot be maintained after the expiration of a limitation period of six years from the date on which the cause of action first accrues to the plaintiff or to a person through whom the plaintiff claims. Under section 5 of the Limitations Act 1958 (Vic) a plaintiff has a time limit of six years from the date on which the cause of action accrued to raise a claim in the Magistrates’Court for pursuing the debt amount, plus interests, and a costs order against the defendant. Time limitations are important to be aware of when a debt claim has not been promptly raised. So when debts are outstanding and the debtor is avoiding meeting their obligations, get that legal advice to protect your legal rights and interests.
