Solicitors, Strata Managers and Landlords need to approach the deal with care. We have just represented a person who found what they thought to be their perfect tenant. It turned to disaster because the lease didnt consider the requirements of the Strata Schemes Management Act 2015. Before leasing a property, a Landlord or their representative should consider the following list: Are the premises zoned to permit the enterprise? Is there a bylaw preventing the enterprise? Will the fit out require strata approval, for example, will there be a need for a development approval that the strata will have to execute? Will the fit out require a common property bylaw, which will require 75% support from the other lot owners? What impact will the enterprise have on insurance? In other words, the Owners Corporation is standing in the way of the Lot owners chosen tenant. ... Section 139 of the Strata Schemes Management Act 2015 prohibits Owners Corporation interfering with a Lot owner dealing on their property. This means in simple terms the Owners Corporation cannot prevent a Lot owner from entering into a lease or granting a mortgage over their property. The question therefore arises whether the Owners Corporation can refuse to sign development approvals or refuse by laws. I think the true position is that, although the Owners Corporation can choose to vote against the by law, they can only do it on reasonable grounds. Owners Corporations have to have good reason to not sign a development approval and be careful in voting down proposed by laws. We buy properties to either live in or rent to others. The legislation clearly gives priority to those who want to rent. See more

07.01.2022 New rules for uncollected goods from 1 July 2020 Since 1 July 2020, new rules have applied to manage uncollected goods that are left behind or abandoned by their owner. The new rules aim to make it easier to return goods to their owners, or to lawfully sell or dispose of them if needed. The new rules provide a lawful process to sell or dispose of goods left behind in boarding houses, community schemes and neighbourhood schemes. Previously, there was no process to sell or di...spose of these goods. The Uncollected Goods Act 1995 also applies to: holiday parks residential land lease communities residential tenancies retirement villages strata schemes. How a person can dispose of uncollected goods will depend on the estimated value and the type of goods involved. There are separate requirements for important personal documents and motor vehicles.
