24.01.2022 Tomorrow never comes..... It's easy to put things off. It's even easier to put things off that make us feel uncomfortable. Family is the most important thing in many people's lives, but for many families, the idea of talking about their family farm and creating a succession plan makes them break out in a sweat.... Here at LH Law helping families work through that process is what we do best. The first step when planning for generational succession is to consider what your family wants to achieve. This first step includes: Information gathering process Establishment of family needs and goals Identification of key issues If you keep thinking that tomorrow never comes, and you don't have a plan for the future, then retaining professional assistance to help you work through the process may just be the missing link. By utilising her mediation, legal and accounting skills, Louise from LH Law can assist each of your family members in having a say regarding their needs and goals. 24.01.2022 Statistics show that families who start the process of future planning early have a much higher chance of achieving a positive outcome for all family members, as well as their agricultural businesses. And thats where Louise at LH Law can help you with planning for the future. Possessing all the skills of a mediator allows Louise to foster a less adversarial approach when working with families. If youre ready to start the process of future planning for your family, now is the time to make an appointment with Louise at LH Law. Call (07) 3180 0126 to book your appointment.

23.01.2022 Weve been meaning to do this for years. A sentiment that is shared by families all over the land. Succession planning is something that you know needs to happen, but you know it wont be a quick 10 minute discussion, so its easier to push to the side. Right? And for some people, COVID19 has been the catalyst for change. For taking action. For putting your family first. The undeniable phrase life is short has felt closer to home than ever before. ... So if youre ready to make sure that the security of your family and your wishes are achieved, then now is the time to start the succession planning journey. COVID19 has taught us many things, and none better than the famous Scouts be prepared. Even though it may feel confronting, its time to take action and ensure that your wishes are in place as you continue on your journey through life. You may already have a Will and Enduring Power of Attorney in place. However these documents rarely stay the same when you undertake your succession planning journey. Having a neutral party involved such as Louise from LH Law with law, accounting and mediation skills from the beginning of your succession planning journey, can ensure that your discussion and planning stays on track and you can tap into Louises business and law experience. Its time to set a date with your family and safeguard their future, and yours.

23.01.2022 Positive outlook for rural property market Predicted rainfall and cheap credit are expected to buffer slowing agricultural land prices in the next 12 months, rural property experts believe. Low borrowing costs, due to the low interest rate environment, have supported land prices by bolstering the buying power of farmers, who can borrow more than what they would have if interest rates were higher. ... The current conditions have also been incentivising farmers to buy, instead of lease land or agist their livestock. Deep-pocketed buyers, including local and offshore corporate farms and institutional investors, are still seeking to pump capital into the Australian agricultural property market.

15.01.2022 Have your adult children protected their future? Many young adults think theyre bulletproof and invincible. So when it comes time to think about protecting their future or what might happen if they had an unfortunate accident or passed away, its put in the too hard basket.... Here at LH Law we are big believers in assisting young adults with protecting their future. As such, we offer a discount to those under 25 when they have their Will and Enduring Power of Attorney documents drawn up. 14.01.2022 Conversations with family. They can be some of the most difficult conversations you will ever have. Throw the topic of succession into the mix, and things increase ten fold. One of the most common questions we get asked here at LH Law is:... I just dont know how to start the conversation with my family. And we completely understand. So it is important to be courageous. Put together an agenda on what you want to discuss, set a time and day and organise with your family. Even though sitting around the kitchen table might seem like the easiest option, its best to organise a neutral venue, away from the farm or business. The next step? It is worth getting a mediator, like Louise from LH Law involved from the beginning. Having a neutral party can help to keep the discussion on track and that you dont dance around the important decisions that need to be made. If you have family or parties involved that decide they dont want to attend, then let them know you will provide an update on everything that happened in the meeting. They then may decide they do wish to be involved the next time you get together for a discussion. Keeping the lines of communication open and honest will go a long way in reaching a mutually beneficial succession plan for everyone involved.

14.01.2022 Set your intentions for 2021 A new year. What does it mean to you? You don’t have to reinvent the wheel, and declare a new year = a new you. ... But you can set your intentions for the year ahead. Maybe you’ve been thinking about creating a succession plan for your family farming business? Perhaps a new property purchase is on the cards with interest rates at historical lows? Or has everything that you’ve experienced in the last year really brought home that you can’t keep putting off updating your Will? Here at LH Law we understand that a new year means something different to everyone. If your intentions for the new year are to protect your personal and business interests, then we’d be happy to guide you through the process. Contact our office on (07) 3180 0126 to arrange an appointment today.

14.01.2022 2020. A year that not only has kept the whole world guessing, but has provided some industries with incredible opportunities and other industries times that they would prefer to leave in the history books. From devastating bushfires, to ongoing drought, then the impact of COVID, this year has provided many challenges, but also opportunities and glimmers of hope. As we transition through the varying stages of change, its important to remember to continue checking in with fri...ends, family, neighbours and work colleagues. Its easy to fall back into business or life as usual. So as you move forward into the rest of this year, please continue to be kind. You never know what a smile, a kind word or a check in could mean in the life of another person.

14.01.2022 Are you becoming frustrated by not being able to reach an agreement? Youre not alone. Many people seek out mediation services because they need a neutral third party to help them reach a mutually acceptable agreement. However, many mediators are based in the city, which isnt always convenient, or the best option for those living in regional, rural or remote areas.... Being a nationally accredited mediator, I can help you work through your mediation issues. As a regionally based meditator, you benefit from being able to tap into this collaborative resource in regional areas, rather than travelling great distances to achieve an outcome. 13.01.2022 Australians are living longer. As Australians are living longer, they are building up considerable assets, including their superannuation death benefit. People passing away at an older age often have children who are experiencing very different life circumstances, which can impact on the nature of estates.... For example, some children with parents dying at approximately 90 years old may have experienced a divorce, their own health problems, career disappointments and so on. Some siblings may be financially secure and have a successful career, while others are struggling in comparison. Given that siblings might be in such different financial circumstances, this can cause a great deal of unrest when an estate is being finalised. Particularly when one child has been more involved with caring for their elderly parents or they have been involved in running the family farm with their parents but the estate is divided equally between all siblings. These new and varied challenges when completing your estate planning are important elements to consider. You can read the original article from In The Back Magazine here: https://www.intheblack.com//wealth-longevity-pose-new-chal If you need help with planning your estate, Louise and the LH Law team can guide you through the process. 10.01.2022 Why does LH Law have a Brisbane phone number? Ive been asked a few times by clients why LH Law has a Brisbane phone number. The reason is that I have an office based in St George, and also an office in Brisbane. ... I have a Brisbane-based office team who assist with answering calls, making appointments, office administration, and paralegal assistance for legal matters. My Brisbane office, which I visit at least once a month for succession and mediation matters can be found at Level 10, 239 George St, Brisbane. One of the benefits of having an office and team based in Brisbane is that it ensures local confidentiality and also provides a neutral space for succession and mediation matters. Being a small rural community, your confidentiality is of utmost importance to me and my firm. So I hope this helps to put your mind at ease when calling our number and making an appointment. 09.01.2022 Have you ever felt like you're not being heard? Handling estate matters can be a difficult time for many families. When family discussions break down, it can be hard to find a middle ground. Instead of going through lengthy (and more often, costly) litigation, mediation can be a more favourable option for families.... LH Law offers mediation services to clients in rural and regional communities. As a Nationally Accredited Mediator, Louise Hill is equipped to help her clients negotiate mutually beneficial agreements, in most often contentious circumstances. Louise is a member of the Australian Mediation Association (AMA) which only selects those Mediators who are recognised for their expertise and standing in the mediation community. Choosing mediation for your estate matter offers both parties a higher level of control over the handling of their dispute. It provides scope for solutions that are almost certainly more favourable compared to the remedies given through the court system or tribunals. So if you're looking for a more positive outcome, then get in touch with Louise at LH Law to discuss mediation options for your estate matter. (07) 3180 0126

08.01.2022 As the sun goes down after another day lawyering and farming in the bush, my thoughts are with people all around Australia, but particularly those in Victoria. We live in the ‘lucky’ country. And it is a beautiful place. But right now, for those who have had their entire world turned upside down, it sure doesn’t feel that way. Every little act of kindness that we offer to our friends and family, and the Victorian community has the potential to make a difference. ... So if you’re looking to purchase a gift, or even some essentials, why not try to support a Victorian business and buy online, if you are able. Continuing to support Australian businesses and Australian people will keep this beautiful country of ours moving forward.

02.01.2022 NO MORE PAPER CERTIFICATES OF TITLE Currently in Queensland, if a paper Certificate of Title is issued for a lot (land that you own), it must be presented to the Land Titles Office as part of the process of selling your land. However, from 1 October 2019, this is all set to change.... Back in March this year, a Bill was passed in Parliament to amend the Land Title Act 1994. The change will see that paper Certificates of Title will no longer need to be lodged with the Land Titles Office when selling your Land, and they will no longer have any legal effect. The electronic title held in the Titles Registry will be the indisputable recognition of ownership within Queensland. Paper Certificates of Title have slowly been phasing out during the last 25 years, with only a small amount of paper titles still in existence. So from 1 October 2019, if you do still hold a paper title, it will no longer need to be provided during a property transaction for the transaction to take effect. If you are involved in a property transaction before this date, and still hold a paper certificate, then it will need to be provided. After this date, it will simply become a historical artifact. If you have any questions regarding paper certificates of title, then please feel free to contact our office directly. (07) 3180 0126

At LH Law we value the importance of personal development and this excellent property law conference provided the perfect platform to continue to enhance our knowledge of property law, together with improvements in software to streamline processes for our clients. There was a lot of great content over the 2-day conference and I left feeling inspired and ready to further assist clients with their property transactions.
