02.01.2022 Nominees under the NDIS What’s it all about? There are two types of nominees under the NDIS. ... 1. Plan Nominee Plan Nominees are treated by the NDIS as being able to make all the decisions that a participant might make - doing phone calls, planning meetings, choosing goals and managing how the plan funds are spent. There can be several Plan Nominees appointed by the NDIS for the same participant. Sometimes Plan Nominees are given a specific set of responsibilities and some responsibilities can be excluded. So a Plan Nominee could be responsible for managing the plan budget, but doesn’t get to decide the goals, for example. This is pretty uncommon though and all Nominee decisions can be appealed through the review process. 2. Correspondence Nominee Correspondence nominees can talk to the NDIS, get information on budgets and balances and get a copy of the plan for example, but are not treated as decision makers. Correspondence nominees do not have access to the participant’s NDIS portal, other than to see a few contact details. No plan or budgets are available online, but they can request this information as needed. 3. Child Representative/Plan Nominee (and turning 18 stuff) Child representatives are usually one or both parents, but where a kid has no parent with responsibility, others can be chosen, often the guardian or whoever is under court orders as having day to day responsibility. All of this can be messy with warring parents, so it’s worth going on the NDIS website and putting Nominee in the search box to learn more. Child representatives are Plan Nominees and have the same responsibilities as Plan Nominees as written above. It’s important to note also, that when a participant turns 18 (or the day or two before), their nominees will be automatically cut off from everything related to their participants NDIS plan, and usually will need to turn up to an NDIS or LAC office with the participant, and 100 points of ID to restore their Nominee status if the young person requests it. This process can vary, and be messy, so in the planning meeting before your person turns 18, make a focussed effort to ask what will happen when the turn 18 and what they and you need to do to ensure a smooth transition. So.., The NDIA presumes that adult participants have the capacity to make decisions about their NDIS plan and funding. Sometimes this will be with support from family or caregivers or providers. For these folks, there will be no nominees appointed. But sometimes a participant is unable to be supported to make those decisions, and the NDIA is required to very carefully consider that situation and who might be the appropriate nominee(s).
