25.01.2022 "I give unto my wife my second best bed with the furniture" part of the last Will of William Shakespeare. If Shakespeare's wife was alive today in NSW she would have a compelling legal basis for challenging his will. Australia does not share the American legal view that the concept of liberty permits a person to leave his or her estate to a pet, a stranger or an association fostering better relations with other residents of the universe. The law in NSW requires the author o...f a will to fairly allocate assets in an estate to or between those who are recognised by the law as having an entitlement. Who are these people? Topping the list are long term partners (irrespective of intractable bitter daily confrontations characterising some relationships), children including step-children and others who may have been emotionally and financially dependent upon the testator. The long forgotten (or never mentioned) love child a result of an impulsive and passionate union many moons ago - may also have a claim on the estate. When preparing your will, you should consider anyone and everyone who may slide into any of the above categories. Resolving the terms of your will requires an objective assessment of who may be entitled, who you think should benefit and drafting a will in terms that will discourage future court challenges. You cannot prevent your will being challenged. You can however discourage a challenge by thoughtfully and compassionately reviewing your personal circumstances and those of your relatives and other past or current dependents. Openly discussing the proposed contents of your will and inviting comments from potential claimants will reduce later conflict. As the Bard said "It is a wise father that knows his own child". 13.01.2022 One of the most significant events in life is buying or selling land or other property. A lot of your money is often tied up with such a transaction. Most of us could not afford a costly mistake made in the course of finalising the sale or purchase. As a buyer or seller you want to be sure you are getting what you are paying for or selling what you believe you own.... You want to avoid claims or demands by the other party after the sale or purchase has been completed. You wish to confidently anticipate being able to sell the property sometime in the future (or confident that your children can sell) without any unforeseen impediments to the sale arising. Did you know, for example, you were selling a block that was previously used as a fuel storage facility such as a petrol station? There may have been underground fuel tanks built on the land but unused for many years. As a seller of land with a fuel storage history, you may have ongoing obligations (even after sale) to return the land to its pre fuel storage condition at your cost. Buying land with access to water over a neighbour's property may mean your right to water could be terminated at any time by your neighbour or a subsequent purchaser from your neighbour. The land may have been recently subdivided with unfenced boundaries. Existing fences may be inadequate. Carefully drawn conditions of contract may be necessary to ensure appropriate boundary and other fences are in place before taking possession of the property. These and many other issues arising in the course of buying or selling land require thorough investigation and careful drafting of conditions of the contract to protect you and, for most of us, our most important asset the land being bought or sold. 10.01.2022 Applying For Bail Bail means being allowed to go free in relation to the offence you are charged with. The decision can be made by a police officer after you have been arrested and given a notice to attend Court. This is known as ‘police bail’. You will have to sign a form acknowledging your bail and its conditions before you will be released. You will be released immediately but you will have to then attend court on your next court date.... The bail sergeant police officer can decide to: -- release you without bail -- grant bail (with or without bail conditions), or -- refuse bail. Common conditions include daily reporting to a police station, to live at a specific address, surrender your passport, not associate with specific people, observe a curfew, and promise not to approach witnesses. If you do not receive police bail, a police officer must take you to the nearest local court as soon as possible to make a bail application for a Judge or Magistrate to determine bail. This is called ‘Court bail’. Offences are categorised as ‘show cause’ or ‘not show cause’ depending on their seriousness. Show Cause Showing cause means you must explain to the court why locking you up is not justified. Any offence that attracts a jail term of life imprisonment and serious charges of a sexual or violent nature are included in this category. The Court will keep you in custody for a show cause offence unless you are able to show there is no unacceptable risk that you will: -- Risk of a failure to attend court if granted bail -- Risk of committing further offences if granted bail -- Risk of endangering or interfering with the alleged victim, witnesses and evidence if granted bail The Court will consider a variety of factors including your background, criminal history and ties, and the nature and seriousness of the offence. If there is no risk of any of the above occurring, your bail application should be granted. Non Show Cause If you have been charged with an offence that doesn’t require you to ‘show cause’, the starting position is that you should be released from custody unless there are reasons for why you should not be released. Factors such as your criminal history, current living arrangements and whether you have a history of not complying with Court orders will be considered by the Court when making such an assessment. Bail Variations If you have a valid need to change a bail condition for example, if you need to change your address you will need to apply for a bail variation. If you fail to do so, you may be charged with a breach of bail which may result in your bail being revoked. Get Our Help We can assist you in your court bail application.
