14.01.2022 Family Related Transfers Transferring property between family members is a common occurrence. This could be a transfer between partners, a gift to a child, sale to a sibling, a relationship breakdown, divorce or death. Once you have decided how the property is to be transferred, I will be able to advise you if the property transfer will be liable for payment of transfer duty, more commonly known as stamp duty.... Stamp duty is determined by the value of the property. The valuation will be carried out by a registered valuer, which I can help you arrange. If part of the ownership is transferred, stamp duty will be calculated based on the share of the property being transferred. My service also includes fulfilling all requirements by the NSW Land Registry Office and Revenue NSW, including any exemptions and declarations to make this process seamless and stress free. If you require a discharge of mortgage or you are borrowing funds, I will liaise with your lender to make sure they will be in a position for settlement to take place. On settlement I will attend to lodgement of the transfer and Notice of Sale electronically and pay settlement monies to the transferor (if applicable). Once settlement has taken place, any title deeds will be sent to you or they will be retained by the bank if there is a mortgage.
