15.01.2022 CONVEYANCING INFO - BUILDING & PEST INSPECTIONS We recommend that you: 1. Engage a licensed Building and Pest Inspector to undertake your inspections.... 2. Get quotes to rectify any issues which your inspector finds if you are intending to request a price reduction. In our experience, buyers are more successful in a request for a price reduction where they can justify the amount they are asking for rather than coming up with a random estimate. 3. Remember that you must act reasonably - you can only terminate the contract if there are significant or structural issues with the property, not because there is a dripping tap. 4. Retain copies of your report, as these will need to be provided to the Sellers solicitor if you armed terminating they contract or seeking a Priced reduction. 5. Inspect the property with the inspectors so that they can better explain some of the issues to you for you to better understand what may be required to rectify them. Make sure that all three sections of the Finance Condition are completed (Financier, Finance Amount, Finance Date). Otherwise, the contract will not be subject to finance.... Further Tip - insert a specific amount for Finance Amount and not Sufficient to Complete and a particular bank rather than Buyers Choice to have more certainty as to the terms of the finance condition. 04.01.2022 GREAT NEWS - We can now witness your Wills by video! This means you wont even have to come into our office to sign your Wills! The Chief Justice of the Supreme Court of Queensland has issued a new Practice Direction to lawyers such that we may witness your Wills via audio-technology:... when the execution of a testamentary document is witnessed by a solicitor using audio-visual technology; during the period of 1 March 2020 to 30 September 2020; and where there is clear evidence showing that the testator (person making their Will) intended the document to take immediate effect as their will. The Registrar has the power to hear and decide applications under section 18(2) of the Succession Act 1981 (Qld) to dispense with the requirement under section 10 of that Act that a party be in the presence of the testator, in so far as such phrase has the meaning at law to be physically in the presence of the testator. It should be noted that the Practice Direction contains this condition - that the reason why the testator was unable to execute the will in the physical presence of two witnesses was because of either government enforced or recommended, or self imposed, isolation or quarantine arising from the COVID 19 pandemic.
