18.01.2022 EMPLOYMENT LAW NEWS High Court decision: Accrual of personal/carers leave. On 13 August 2020, the High Court of Australia has handed down the much anticipated judgement in the appeal of AMWU v Mondelez with respect to personal leave accrual rates for part time employees.... Originally, in August 2019, the Full Court of the Federal Court observed that part time permanent employees were entitled to ten full days paid personal / carers leave annually, irrespective of the pattern of hours completed. That is, it was held that two 12-hour shift workers were entitled to 120 hours of paid personal / carers leave, instead of payments for 10 shifts of 7.6 hours (76 hours). The High Court however, has reversed the Full Federal Courts decision and has maintained the current interpretation of section 96 (1) of the Fair Work Act 2009 (Cth). That is, a part time permanent employee should accrue personal / carers leave on a pro-rata basis of a full time employee and 10 days in the Mondalez case, is two standard five-day working weeks. Similarly, 1 day refers to a notional day (not a calendar day) consisting of one-tenth of the equivalent of an employees ordinary hours of work during the two-week cycle. However, as patterns of work may reflect a different cycle, 10 days of personal/carers leave can be calculated as 1/26 of an employees ordinary hours of work annually. This decision has provided much needed certainty for employers with respect to accrual rates of part-time entitlements.
