23.01.2022 New Get Permission hunting App launched in time for Easter - an initiative to help address Illegal Hunting and Trespassing. The Rural Crime Prevention Teams... and the NSW Department of Primary Industries (DPI), Game Licensing Unit, is calling on all hunters to hunt safely, abide by the rules and have permission to hunt before they enter private and public land this Easter long weekend. DPIs Game Licensing Unit, Director, Dr Andrew Moriarty said hunters not having permission from landholders and land managers to hunt on both private and public land continues to be an issue. "Permission is required before entering any lands for the purpose of hunting, however we have made it even easier for hunters to comply with hunting permission requirements with the recent launch of the Get Permission App, Dr Moriarty said. The Get Permission App was launched at the Sydney Royal Easter Show by Dr. Moriarty and State Rural Crime Coordinator Detective Inspector Cameron Whiteside. The App allows hunters to quickly and easily request and store permissions from landholders and store copies of licences, should they be requested by authorities. The App also allows landholders to authorise hunters to hunt on their lands and review the permissions they have granted and revoke them at any time. The Get Permission App will revolutionise the way permission is granted to hunters, particularly those hunting on private lands. We encourage all hunters who hunt on private land and any landholders who have hunters attend their properties to utilise the Get Permission App. The App is the latest initiative as part of the Shut the Gate on Illegal Hunting Program, a joint inactive between DPIs Game Licensing Unit and NSW Police Force. A number of the RCIs assisted the DPI in the development of the App. The App is not monitored by the Game Licensing Unit or NSW Police Force and has been designed as a tool for hunters and landholders and to highlight the issues around illegal hunting. The message is simple; get permission. The Get Permission App is free to download from the Apple App Store and the Google Play Store.

09.01.2022 Perhaps youre wondering what the image is, on our timeline photo. In 1939, the Water Tower for the Warren Shire Council was completed. The mayor at the time ...was Eric Reginald Green, who held his position as major for 13 years. At the time, Eric was the youngest mayor in Australia. Eric Reginald Green was the Green of Lovett & Green Solicitors, a business that he established with his father-in-law, Mr Lovett. Mr Lovett had arrived in Warren in 1894. The ashtray was cleverly created by Harry Woolnough, who was the inspector for the Water Tower project. Harry was an engineer, who owned and operated Woolnoughs Pumps & Motors in Dubbo Street* (now known as Menzies Pumps & Irrigation). Harry made the ashtray on a lathe, and presented it to Eric on the completion of the project. The engraving on the ashtray says:~ Eric Green - Mayor, Harry Woolnough - Inspector, Sir John Butters - Engineer, and J.D. Cable - Contractor. *It has been suggested that the original location for Woolnoughs Pumps & Motors was on the corner of Lawson & Readford Streets. If you can supply any other information about this, or about the history of this ashtray, please message our page, or email us at [email protected].

08.01.2022 Firearms Safe Storage changes On the 1 September 2017 the Firearm Regulation was enacted which has brought about some changes, in particular to the safe storag...e requirements of firearms. This new requirement was introduced in response to increasing firearm theft from unattended rural residences and buildings or structures (i.e. sheds) located well away from the residence. Clause 38 of the Firearm Regulation 2017 states, - all licence holders to store their firearms at residential premises that are the principal place of residence of a person or a person is residing at the premises when the firearms are stored there (whether or not that person is the licensee). - if the firearms are stored in a building or structure that is separate from the residential premises, that building or structure must be easily observed from the residential premises. The safe storage of firearms is of particular concern to our rural and remote area. In the last 2 years, 10 firearms were stolen throughout the Central North Police District. Central North Police District will soon commence safe storage inspections to ensure all firearms are being stored in line with the new requirements. Police encourage the community to view the NSW Police Force website or contact the Firearms Registry or Local Police for more information.

06.01.2022 People often ask us if they need a Will if they dont have anything to give away. The answer to that is a resounding yes. Wills are not just for the wealthy. Regardless of the money or assets you may have, a Will gives you the peace of mind that your loved ones will be looked after if something were to happen to you. It ensures that your assets are given to who you want, by who you want, and that your minor children are looked after. If you have been saying we will get to that one day, make that call today. The cost is certainly worth the peace of mind.

03.01.2022 WHY USE A TESTAMENTARY TRUST? Testamentary trusts have a number of benefits- asset protection, flexibility, and, primarily, tax advantages through income splitting. Take Jack for example- Jack wants to leave the whole of his $1,000,000 estate to his only child, Jill. Jill has three children herself: Peter, Paul and Mary. All three children are under 18 and dont have paying jobs. ... Jill works full time and earns $90,000 a year. The income produced from her inheritance at 6% per annum takes her income to $150,000 a year- on this, she pays 37% tax- meaning from the $60,000 additional income she receives each year after her fathers death- $22,200 goes to tax. If Jack decided to leave his estate in a testamentary trust to benefit his family, Jill as Trustee could make distributions to her own children. Although Jills children wouldnt usually have the benefit of the tax free threshold being under 18, as the income isnt from employment, if they received the distribution via a testamentary trust, they would receive the benefit of the tax free threshold of $18,200. This means, Peter, Paul and Mary would only pay tax of $342 each, compared to the $22,200 that Jill would pay. If you would like to have a chat about your estate plans, and whether a testamentary trust may be appropriate for you, please call Lovett & Green on (02) 6847 4701.

02.01.2022 DO YOU HAVE A FAMILY TRUST? Earlier this year, legislative amendments were enacted which may have costly implications for many discretionary trusts, including ordinary family trusts and testamentary trusts. These new changes mean that, unless the trust expressly prevents a foreign person from being a beneficiary of the trust, the trustee of a discretionary trust is now taken to be a foreign trustee, and will therefore be liable for additional taxes on residential land hold...ings. As most standard trust deeds will not include an express provision that excludes a foreign person from being a beneficiary, in many cases the trustee will fall afoul of the new provisions and be deemed a foreign trustee, unless an exclusion clause is added. The Commissioner has given trustees until 31 December 2020 to amend their trust deeds so that they comply with these legislative changes. We recommend that all trustees of family trusts have their trust deeds reviewed by their legal advisor as soon as possible. Lovett & Green can be contacted on (02) 6847 4701 with any questions on your family trust.
