16.01.2022 The Fair Work Commission has announced a 1.75% increase to minimum wages. This will apply to all award wages. Increases to awards will start on 3 different dates for different groups of awards. For anyone not covered by an award or an agreement, the new national minimum wage will be $753.80 per week or $19.84 per hour. 16.01.2022 Judgment Just In: The Court of Criminal Appeal has unanimously dismissed an appeal from a decision of the District Court, which held that evidence that the complainant had made false allegations of sexual assault on 12 prior occasions, and which was sought to be adduced by the accused, was inadmissible pursuant to s 293(3) of the Criminal Procedure Act 1986 (NSW). The Court of Criminal Appeal held that the evidence sought to be adduced by the accused fell under s 293(3) and ...that the exception to the operation of s 293(3) contained in s 293(4)(a) was not applicable. The Court of Criminal Appeal further held that s 293 was not invalid for infringing an implied limitation on State legislative power, and refused to permanently stay the proceeding. 04.01.2022 MSN Sydney news has reported that the NSW Police may likely be pursued in a class action lawsuit over unlawful strip searches, which included children, dating back to 2015. The Law Enforcement (Powers and Responsibilities) Act 2002 allows a police officer to carry out a strip search of a person if the officer suspects on reasonable grounds that the search is necessary The police officer must conduct the least invasive kind of search practicable in the circumstances.... A search must be conducted by a police officer of the same sex as the person being searched and must, as far as is reasonably practicable in the circumstances, comply with the following: a) The strip search must be conducted in a private area b) The search must not be conducted in the presence or view of a person who is of the opposite sex to the person being searched, c) For a person between the age of 10 years and 18 years, a parent or guardian or another person who is not a police officer and who is capable of representing the interests of the person being searched and whose presence is acceptable to that person must be present. There are very strict exceptions to these rules that must be also followed if a police officer wishes to conduct a strip search. A strip search must not: a) Be conducted on children under 10 years of age, b) Involve a search of a person’s body cavities or an examination of the body by touch c) Involve removal of more clothes than the person conducting the search believes on reasonable grounds to be reasonably necessary for the purposes of the search, d) Involve more visual inspection that the person conducting the search believes on reasonable grounds to be reasonably necessary for the purposes of the search. With all the discretion allowed by the current law, it is no wander law firms such as Slater and Gordon are considering class actions against the State. Redfern Legal Centre is working with law firm Slater and Gordon to investigate if it can seek compensation for thousands of people who may have been unlawfully searched in the past six-years.
