25.01.2022 Temporary changes to the Fair Work Act have come into effect to support the implementation and operation of the JobKeeper wage subsidy scheme in Australian workplaces. In certain circumstances, the changes allow eligible employers to give directions to temporarily: stand down an employee (including by reducing their hours or days) change an employee’s usual duties... change an employee’s location of work. The changes also allow eligible employers and employees to agree to change days and times of work and take annual leave. Any directions or agreements can’t reduce minimum pay rates or other monetary entitlements under the Fair Work Act (like penalty rates, overtime or allowances) and other employment terms and conditions not related to the direction or agreement (like sick and carer’s leave) continue to apply. 19.01.2022 We are very appreciative and humbled to be appointed to the National Sports Tribunal Panel (NST) effective immediately. The NST will provide sports, athletes and athlete support personnel with a cost-effective, independent forum for the timely determination of disputes through private arbitration, mediation, conciliation or case appraisal. It will strengthen sports dispute resolution transparency and accountability as part of an overall reform of Australia’s sports integrity arrangements. The NST will initially be established as a two year pilot, commencing 19 March 2020.

16.01.2022 Have you experienced abuse / sexual assault whilst in the ADF? The Australian Government has extended the Defence Reparation Scheme by a further 12 months. To receive a reparation payment, you must contact the Ombudsman’s Office by 30 June 2022 and either:... submit a report of the abuse you experienced in Defence or provide written notification that you intend to submit a report of abuse which you must then submit by 30 June 2023. It is important to note that: if you do not submit your report of abuse or an intention to report abuse by 30 June 2022, you cannot receive a reparation payment. If you provide a written notification of your intention to submit a report of abuse, but do not submit your report by 30 June 2023, you will not be able to receive a reparation payment. Repatriation payments are limited to the most serious forms of abuse and/or sexual assaults, not all reports of abuse will meet the threshold to receive a payment.

The proposed Bill, which will be debated in parliament this week, would make it a crime to publish the name of any deceased sexual assault victim from Victoria. It would also have the effect of preventing grieving relatives from ever speaking directly to media under their real names or writing autobiographies if doing... so could be seen to identify the victim. 08.01.2022 Are you married? You need a will. If you are married, then you need a will because your spouse is someone who is so closely tied to you that it’s important for you to put in writing whether she or he gets your assets upon your death. Traditionally, your spouse would likely inherit your things even if you die without a will, but you shouldn’t leave that up to chance. Additionally, if you want anyone other than your spouse to receive any of your assets, you would need to include that in your will because that isn’t the default.

04.01.2022 Do you have kids? You need a will. If you have kids, you need a will because your kids are likely to inherit your things if you die intestate, after your spouse, but not necessarily. This means that if you want your kids to inherit after your spouse, then you need to put that in writing so there is no room for error or interpretation by the courts. Additionally, if you don’t want one of (or all of) your kids to inherit, then that needs to be in writing.... Whether you want your kids to inherit your assets or not, it is likely that you have feelings about it one way or another. For this reason, it’s very important that you have a will in place so that the decision is being made by you, not the state. Another reason why a will is important if you have kids is because you name an executor of your estate and a guardian of your children. The executor is responsible for distributing your assets, and the guardian is responsible for raising your children. Who you name as executor and as guardian is critically important to how your children inherit and how they are raised.
