05.01.2022 When does a Retaining Wall require a building approval? This is determined through assessing any site restrictions applicable to the lot along with the developm...ent standards in Part 2 of the State Environmental Planning Policy Exempt Development Codes (2008). Subdivision 15, as it relates to Earthworks, retaining walls and structural support, outlines the following for a retaining wall to be exempt: The wall must not be more than 600mm in height (when measured from the Existing Ground Level) The wall must be located at least 1m from each lot boundary The wall must be located at least 40m from a natural waterbody The wall must not redirect the flow of water onto adjoining properties The new wall must be separated from any other retaining wall or structural support on the site by at least 2m, measured horizontally The wall must be located at least 1m from any registered easement, sewer main, or water main The wall must be supplied with adequate drainage lines which are connected to the existing stormwater system Note: This is not a complete list of all items to be considered when determining a wall as exempt development. For the full list of requirements please follow the link to the SEPP Exempt and Complying Development CODES (2008). www.legislation.nsw.gov.au/#/view/EPI/2008/572/part2. Prior to construction it is advised that you contact AcroCert to provide further information. If the retaining wall does not meet all of the requirements in Subdivision 15, either a DA and Construction Certificate or Complying Development (whichever is applicable) must be obtained for the wall before building works commence.
