25.01.2022 If you’re on a salary it can’t be less than the minimum entitlements you’d get under your award or enterprise agreement and the National Employment Standards. Y...ou also have non-monetary entitlements that can’t be excluded by a salary like getting pay slips and the right to request flexible working arrangements. Your boss needs to keep track of when you’re working and regularly audit your salary to make sure that you’ve been paid correctly. Specific rules can also apply under your award or agreement, including requirements about record keeping and reconciliation. Check out our salary page for more info about your minimum entitlements: https://www.fairwork.gov.au/p/minimum-wages/salary-payments

15.01.2022 Do you know your tax myths from tax facts? Test your working-from-home knowledge below as we set the record straight. Myth: If I use the shortcut method, I ...can claim 80 cents per work hour plus other equipment (that costs $300 or less) to use when working from home. Fact: Under the shortcut method you can only claim 80 cents per work hour. This method covers all deductible expenses, including office furniture and technology. You can’t claim any other working from home expenses on top. Myth: I can claim everything I bought to work from home (new laptop, desk, toilet paper, tea or coffee and my kids’ education supplies). Fact: There are three methods you can use to calculate your working from home expenses. You can choose the method that will give you the best outcome but you must meet the eligibility and record keeping requirements. You cannot claim items such as toilet paper, tea, coffee or your kids’ education costs, these are private expenses. Myth: I can’t claim my working from home running expenses, even though I share the costs with my housemate because the bills aren’t in my name. Fact: Under the shortcut method multiple eligible taxpayers working from the same home can each claim 80 cents per work hour, even if the utility bill isn’t in your name. 20.12.2021 Sick leave is for when you can’t work because you have an illness or injury. You can generally only use sick leave for pre-arranged appointments, like medical ...consultations or elective surgeries, if you’re also unfit to go to work because you’re sick or injured. If you need to see a practitioner like your doctor, dentist, nutritionist, acupuncturist or physio but are fit for work, you can talk to your boss about other options like taking another type of leave or making up the time later. It’s a good idea to check if your workplace has any policies for these types of situations. While you don’t have to disclose a medical condition to your boss to be paid sick leave, you do have to give notice and they can ask for evidence (like a doctor’s certificate) to confirm that you were unfit for work: https://www.fairwork.gov.au//notice-and-medical-certificat

02.12.2021 Scenario: Kim called us for advice about her pay and leave entitlements. She spoke to her boss about what she learned. After their conversation, Kim’s boss cut ...her hours each week until she was no longer on the roster. This is an example of adverse action because she exercised her right to make an inquiry to us about her pay and entitlements. Kim shouldn’t face any adverse action for using her workplace rights to ask her boss about her pay or coming to us for help. It's unlawful for a person to take adverse action against another person including for: having or using a workplace right belonging or not belonging to a union taking or not taking part in industrial activity having a protected attribute like their race, sex, age etc. Some examples of adverse action include shifts being reduced, being fired, having your job changed to your disadvantage, not getting your legal entitlements like pay and leave. Or being threatened with any of the above. We’ve got more info about protections at work including examples: https://www.fairwork.gov.au/employee-e/protections-at-work

26.11.2021 What should be in your final pay? A) Unpaid wages including penalties and allowances. B) Unused annual leave (if you’re part-time or full-time). C) Annual leav...e loading (if it’s been paid to you during your employment). D) All of the above. You’ve got a perfect score if you answered D! Any annual leave you’ve got accrued must be paid as if you were employed (so if you normally get annual leave loading when you take annual leave it has to be paid out to you on termination as well). There may be other entitlements paid to you on termination depending on your individual circumstances like: accrued or pro rata long service leave payment in lieu of notice redundancy pay. Use our online calculators to work out what should be in your final pay: https://www.fairwork.gov.au//notice-and-final-pay/final-pay

Our list has them all covered: https://www.fairwork.gov.au//publi/list-of-public-holidays Pro tip: public holidays don’t come out of your annual leave balance, so you can use them to boost your paid time off.
