Before transferring money to your solicitor or conveyancer always phone them on their advertised office phone number to check that they have requested the transfer and have them read out the bank account numbers over the phone. Your solicitor should do the same when they have your bank details to pay money to you. Alternatively, use the PEXA Key app to securely provide your bank details for settlements.

The introduction of the new law is controversial as it appears to be contrary to the Governments 2017 reforms which were aimed at reducing disqualification periods. There are still many ways for people to resolve their family law disputes without going to court and this must always be the aim of the parties and the legal practitioners who assist them. However, there are some disputes which are not able to be settled and have to proceed to a court hearing. In those instances, it is vital that people have access to quick, effective and efficient justice. Without additional funding, a simple merger of the courts is unlikely to promote this aim and may lead to very poor outcomes for some families given the potential loss of specialisation within the Court.

The current delays in the Sydney Registry between filing an application and reaching a final hearing is about 3 years - much too long for families in turmoil to wait for a resolution. The best resolution is always one which parties can agree on themselves, however there are always a small minority of cases that need judicial determination and this is where the government must take action to provide a quicker and more efficient system to finalise those cases.

12.01.2022 Before this recent High Court decision we were of the view that the Courts’ decisions were moving more and more toward upholding Financial Agreements and not saving people from a ‘bad bargain’ - however this judgment may well reverse that trend. It is early days to tell how this decision will be applied in the Family and Federal Circuit Courts, but it's safe to say that Family Lawyers need to take a wider view of the bargain and the respective positions of the parties when a...dvising on these agreements to properly protect their clients. The take away from this is that preparation of Binding Financial Agreements (including the agreements sometimes called ‘pre-nups’) is a highly specialised area of law which requires careful drafting and comprehensive advice.
