09.01.2022 Leasing Update | The NSW Government has announced that the Retail and Other Commercial Leases (COVID-19) Regulation will be extended until 31 December 2020. The announcement sets out that landlords can claim a 25% land tax concession where they provide rent relief to tenants in financial distress from October to December.... Further, tenants will be required to re-establish their eligibility under the extension of the Regulation if they wish to request further rent relief.

07.01.2022 Legal Update | Discretionary Trusts and Foreign Purchaser Surcharge Duty & Land Tax Do you have a Discretionary Trust which owns property in NSW? If so, keep reading this update to ensure you are not caught out by new tax arrangements which start 1 January 2021.... In NSW, Foreign persons who buy or own residential land must pay a foreign surcharge on that property, including: 1. Surcharge purchaser duty - a surcharge of 8 per cent, in addition to your transfer duty. 2. Surcharge land tax - surcharge on the taxable value of all the residential land you own as at 31 December each year, in addition to any land tax you may already pay. You may need to pay the surcharge even if you don’t pay land tax. There are Transitional arrangements which are ending 31 December 2020. Trustees of discretionary trusts will be treated as foreign persons unless the trust deed irrevocably excludes foreign persons as potential beneficiaries, even if there are no actual foreign persons who are beneficiaries. If the terms of a discretionary trust which has acquired residential land have not been amended to irrevocably exclude foreign beneficiaries before midnight on 31 December 2020, the trustee of the discretionary trust will be liable for: - surcharge duty on transfers of dutiable property that have occurred or occur prior to 31 December 2020; and - surcharge land tax in respect of the 2017, 2018, 2019 and/or 2020 land tax years. Please consider obtaining independent legal & financial advice on whether these changes impact on your current Trust Deed or property portfolio owned under a discretionary trust structure. 07.01.2022 Judgment Just In: The Court of Appeal has dismissed an appeal brought by a purchaser in a contract for sale of a residential property in Woolloomooloo. The ven...dors had obtained development approval to conduct renovations on the property, but did not finish them all before selling. The purchaser argued that a condition in the contract required the vendors to complete the rest of the work. The Court disagreed. It found that the relevant clause did not contain a promise that all the work had to be completed, and that an occupation certificate provided by the vendors was sufficient to allow the purchaser to occupy the property.
