14.01.2022 Back in March, the National Cabinet agreed to a 6-month moratorium on rental evictions to support residential tenancies in Queensland impacted by COVID-19. This moratorium, and measures implemented to support it, will cease to apply after 29 September 2020. Other protections will continue to apply until 31 December 2020, including provisions allowing tenants experiencing domestic violence to quickly end their tenancies, limits on reletting costs for eligible tenants who end fixed-term tenancies early, entry restrictions to support COVID-19 social distancing measures, and relaxed repair and maintenance obligations. 11.01.2022 On 16 September 2020, the Queensland State Government extended the moratorium on commercial evictions from 30 September 2020 to 31 December 2020. This means the... ability for lawful evictions upon commercial tenants will come into effect from 1 January 2021. Until the close of December, landlords and tenants must continue to negotiate with each other in good faith to ensure the continuation of their leases during the COVID-19 pandemic for this extended period. Landlords remain restrained from taking prescribed actions against a tenant for non-payment of rent, outgoings, or other lease payments. 05.01.2022 Last week the High Court of Australia granted WorkPac special leave to appeal the decision in WorkPac v Robert Rossato. 05.01.2022 On March 25th, 2020, temporary debt relief measures for individuals and businesses facing financial hardship, due to the economic impacts of COVID-19, came into effect. As part of the changes made to Commonwealth bankruptcy law, the debt threshold required of creditors to apply for a bankruptcy notice against a debtor was increased from $5,000 to $20,000.
