25.01.2022 Gov. Polis issued an executive order determining that law firms are deemed as providing essential services and therefore attorneys are permitted to go into their offices. But what about electronic signatures on documents; especially now that many clients prefer to discuss matters via phone or email but documents require signatures? The Uniform Electronic Transactions Act and the federal Electronic Signatures in Global and National Commerce (ESIGN) Act provide that electroni...c signatures are enforceable and treated the same as any document signed by traditional means. But what if a signature requires notarization? Gov. Polis' executive order permits a notary to view a signature remotely via facetime, etc. and then notarize the signature.
