20.01.2022 Property owners beware. The Sale of Land Act in Victoria has very recently changed. It arguably increases the obligations on vendors to disclose certain matters... about their property. Material facts which are not obvious about a property must be disclosed. Examples will include a previous murder at the property and if there was a meth lab for example. These things arguably had to be disclosed anyway. The law is now wider in that it will be mandatory to disclose the presence of combustible cladding, building work on the land that did not have the required permit or approval, prior tests revealing structural defects, termite infestations, asbestos and other contaminations. Finally, as it is not concrete yet, it may well be that vendors will have to disclose development proposals, even possibly ones that did not proceed. Stay tuned for further updates.
