When negotiating the division of the de facto or matrimonial asset pool at the end of a relationship, we are often asked about the impact of gifts received during the relationship and whether or not they will be counted as a part of the asset pool. Ordinarily, when one of the parties has received a significant gift of assets or money, the court will consider the gift to have been a contribution made by the recipient and adjust the sett...lement accordingly. Oftentimes there is a disagreement between the parties as to whether the assets or money were received by way of gift (ie non-repayable) or loan (ie repayable and therefore a liability of the relationship). The existence of a loan agreement entered into at the time when the loan was advanced will go a long way towards establishing the receipt as a loan (and not a gift).
