24.01.2022 PARENTING CHANGEOVERS IN NSW IN LIGHT OF COVID-19 Since COVID-19, we have had a number of clients seeking clarification regarding whether they can travel to meet the changeover obligations within their parenting orders. Below is an overview of the newly introduced Public Health (COVID-19 Restrictions on Gathering and Movement) Order 2020, dated 30 March 2020. In NSW, the state government directs that a person must not, without reasonable excuse, leave a persons place of r...esidence.However, it defines a reasonable excuse, among others, as the following: 1.travelling for the purposes of attending childcare; 2.facilitating attendance at a school; 3.undertaking any legal obligations. Further, the NSW Government has directed that a person must not participate in a gathering in a public place of more than 2 persons unless, among others, that the gathering is necessary for the person to fulfil a legal obligation. In light of the above, travelling in NSW to facilitate changeovers between parents in circumstances where parenting orders exist, is not banned and should not be used as an excuse not to comply with parenting orders. 19.01.2022 QUEENS BIRTHDAY HONOURS As usual on Queens Birthday, a number of people in this country are honoured for their services to the community. Among them this year were high-profile politicians such as Tony Abbott and Bronwyn Bishop and also former cricket captain Michael Clarke. The knighthoods in Australia were abolished by Bob Hawke in 1986, however in 2014, Tony Abbott unilaterally reinstated the honours. Since 2014, four people have received a knighthood, including oddly P...rince Phillip. While it is important to acknowledge the links we have to the UK and more broadly the Commonwealth, I look forward to the day in the near future that Queens Birthday is replaced by Australia Republic Day. 17.01.2022 LEGAL COSTS IN FAMILY LAW PROCEEDINGS Often in a family law context, I get asked by clients whether the other side will have to pay our legal costs for bringing proceedings before the court. My advice to clients is under section 117 of the Family Law Act, each party must bear their own legal costs, however there are occasions when the court may entertain the idea of awarding costs against the other party.... Circumstances which the court will take into consideration are: The conduct of the parties; Whether a party has failed to comply with previous court orders; Whether a party to the proceedings has been wholly unsuccessful; and Whether an offer has been made to either party to settle proceedings. 16.01.2022 NO HAND SANITISER AVAILABLE IN LOCAL COURT This morning I had an appearance in the Downing Centre Local Court. I give the Court credit for enforcing social distancing wherever possible. Security were vigilant upon entry and matters were only called one by one to reduce numbers in court rooms.... Alarmingly however, at no place throughout the entire courthouse were hand sanitisers available for public use, forcing people to use their bare hands to put their belongings in plastic containers to go through the security checks, and open doors to enter the court rooms. In my view, this is totally unacceptable. According to todays statistics, globally the death toll stands at 19% of all those infected by COVID-19. This is yet another example of an organisation either not treating this virus seriously enough, or not acting with enough urgency to prevent further community transmissions. It shows a lack of leadership on this issue. If the courts are unable to source basic hygiene products to reduce the spread of COVID-19, they should be closed immediately until they are able to do so. The more effectively we are able to contain COVID-19, the faster we, as a country, will be able to bounce back from it.
15.01.2022 ECONOMIC UNCERTAINTY AND THE IMPACT ON RELATIONSHIPS Interesting article here regarding the impact that economic pressures have on relationships. UK research shows that unemployment is associated with lower relationship happiness. However, while women are less happy with their partner being unemployed, the opposite is not true. Mens relationship happiness does not seem to be affected by their partner being unemployed.... The article continues to analyse the difference between married and non-married couples and their financial and mental wellbeing. In light of this, and the present pandemic, it will be interesting whether any long term societal shifts occur in this country. 15.01.2022 WITNESSING LEGAL DOCUMENTS ELECTRONICALLY As a result of COVID-19 restrictions, concerns were raised about the difficulties that the restrictions had created for individuals being able to have their legal documents witnessed. As a response to this, the Electronic Transactions Amendment (COVID-19 Witnessing of Documents) Regulation 2020, has been recently introduced in NSW. This effectively means that a legal practitioner can electronically witness any of the following docume...nts: (a) a will, (b) a power of attorney or an enduring power of attorney, (c) a deed or agreement, (d) an enduring guardianship appointment, (e) an affidavit, (f) a statutory declaration. Witnessing can occur by any technology that enables continuous and contemporaneous audio and visual communication between persons at different places such as Skype or FaceTime or video conferencing. 15.01.2022 FURTHER RESTRICTIONS LIFTED IN NSW The NSW Premier announced yesterday that as at 1 June 2020, restaurants, cafes and pubs will be able to serve up to 50 patrons observing the one person per 4 m rule. In light of the very low numbers in NSW, I think this is a sensible approach as the social and economic impact of lengthy restrictions would undoubtedly have catastrophic consequences.... Further, I would expect within 1-2 weeks that interstate travel will recommence, thereafter, and by July, the trans-Tasman bubble will open, allowing Aussie & Kiwi cousins to be reunited again. In my view, this is a safe, sensible and practical approach to take. It is interesting however to observe the contrast in political discourse between NZ leadership and QLD leadership with regard to reopening borders. NZ are very keen to recommence trans-Tasman travel with its largest trading partner, while the QLD Premier has rebuffed overtures by the NSW Premier to lift border restrictions. In my view, I say tear down that wall. Lets resume with interstate travel and trade in a COVID safe environment.
14.01.2022 INTER STATE TRAVEL FOR PARENTING ARRANGEMENTS Recently due to COVID-19 outbreak, the NSW State government issued an order prohibiting Victorians from entering NSW except under certain circumstances. This has created a number of problems in relation to parenting arrangements especially in border town communities. According to the Public Health (COVID19 Border Control) Amendment Order 2020, a 14 day permit may be issued to enter NSW if the holder is entering on the basis of ...child access and care arrangements. In obtaining a permit you may be required to self isolate for 14 days, get tested for COVID-19 or abide by a COVID-19 safety plan among other conditions. Breaches of this public health order can be severe with the maximum penalty being an $11,000 fine and a term of imprisonment of up to six months. Should you live in Victoria and need to cross the NSW border, you should have your photo ID, a copy of your parenting orders or parenting plan, and the contact details of the other parent in case they need to be contacted by police. NZs Principal Family Court Judge said that in situations where shared custody arrangements exist, children should not be moving between homes if that involved shifting between different towns or communities.... New Zealands lockdown laws are at Alert Level 4, and are presently more restrictive than Australias, however undoubtably moving forward, due to the geographic distances found in many parenting matters in Australia, similar responses must be considered. While this catastrophe is changing on a daily basis, it would be highly likely that a further announcement will be made by the government further restricting the movement of people outside their homes. 07.01.2022 FAMILY COURTS TO STAY OPEN DESPITE COVID-19 CRISIS The Federal Circuit Court and Family Court Chief Justice Will Alstergren said the Family Courts will stay open despite the current crisis overwhelming the country. Justice Alstergren said the courts will hold as many hearings as possible using video conferencing or telephone, but where in-person appearances needed to occur, they would.... In times of crisis, there is greater propensity for family violence, he said. We have to make sure we provide access to justice, we have to ensure people are properly cared for in those times. Since the spread of the Coronavirus, a number of changes have occurred in the Family Courts. The number of people in a court room has been reduced, cases are being staggered, hearing times reduced and rooms cleaned afterwards. 03.01.2022 THE IMPACTS OF COVID-19 ON PROPERTY SETTLEMENT MATTERS Undoubtedly as legal practitioners, the coronavirus has challenged us to adapt to a rapidly changing working environment. Significantly however, it has also changed the way that clients are approaching splitting their assets. Some of the negative impacts arising from COVID-19 in a property settlement context are as follows:... 1. reduced capacity to refinance with an uncertain market; 2. reduced value of super due to market crashes; 3. reduced ability to sell a matrimonial home; 4. loss of job/reduced income and the impact of that on capacity to refinance and payout the other party. However, we are finding that parties are using the effects of Covid-19 to their ADVANTAGE moreso than to delay a property settlement. In the last week we have seen that parties are quick to: 1. update disclosure of super statements because their super has reduced in value; 2. obtain appraisals/valuations of properties because of the reduction in house prices; 3. propose more realistic cash payouts because of their reduced capacity to refinance; 4. propose sale of the matrimonial home due to the likely difficulties of selling in this current market; 5. propose a further valuation of their business due to the likelihood it has decreased in value. 01.01.2022 DRIVER LICENCE DISQUALIFICATION MATTER This week I appeared in a traffic law matter at the Downing Centre in central Sydney. My client had been disqualified from driving until the year 2057 due to a number of offences and being declared a habitual traffic offender....
