22.01.2022 Unfair Dismissal - what does it mean? Employees whove lost their employment for one reason or another can often be confused as to their rights. Quite rightly so, the concept of unfair dismissal isnt really straightforward as people think. Further, people appear not to be bothered to pursue their rights through lawyers - for obvious reasons of expense, stress of litigation, and that option of choosing to move on and find alternative employment. But its important to know so ...that youre protected when you find yourself in an unfortunate situation of having lost your job. So then, what does unfair dismissal mean? A person is unfairly dismissed if the Fair Work Commission is satisfied that: - the person was dismissed; and - the dismissal was harsh, unjust and unreasonable; and - the dismissal was not consistent with the Small Business Fair Dismissal Code; and - the dismissal was not a case of genuine redundancy. etc Dismissed means: - the person was dismissed at the initiative of the employer; or - the person resigned from his/her employment but was forced to do as a result of the conduct of the employer. Harsh, unjust and unreasonable means: - whether there was a valid reason for the dismissal related to the persons capacity; and - whether the person was notified of the reason for dismissal; and - whether the person was given an opportunity to respond; and - whether there was unreasonable refusal by the employer to allow the dismissed person to have a support person; and - if dismissal is related to unsatisfactory person, whether the person was warned of his or her performance. etc If the above or any of the above relates to you, it may be necessary to seek legal advice. 19.01.2022 The National Cabinet recently passed Mandatory Code of Conduct, SME Commercial Leasing Principles, in response to the impact of Covid-19 on commercial tenants. The Code of Conduct is a set of principles dealing with the relationship between commercial landlords and tenants during this time of Covid-19 restrictions. It encourages parties to negotiate in good faith. 19.01.2022 Consumer Guarantees under the Australian Consumer Law Australian consumers are guaranteed protection under the Australian Consumer Law (ACL). The Guarantees are a comprehensive set of rights protecting consumers when they acquire goods or services. Suppliers and manufacturers automatically provide guarantees about goods they sell, hire or lease and services they provide. Any goods or services costing up to $40,000; goods or services costing more than $40,000 and are for pe...rsonal, domestic or household consumption are covered under the ACL. A Supplier or manufacturer is required to guarantee, amongst others, that goods are of acceptable quality; match any description provided; honour express warranties; are fit for any disclosed purpose. For suppliers of services, the ACL requires that services are provided with due care and skill; are fit for purpose; and are provided within a reasonable time when there is no agreed date. 15.01.2022 Successful outcomes Weve had three outstanding outcomes in court since Wednesday last week. On 27 March 2019, our principal, Mr Mayek, successfully defended a recovery claim against our client by his previous solicitors. Mr Mayek successfully argued that this was not a recovery claim but a costs dispute which should be assessed by the Local Regulatory Authority before the plaintiff may have the right to recover. The Magistrates Court agreed and ordered for the transfer o...f the matter to the Victorian Civil & Administrative Appeals Tribunals Legal Services List for a costs assessment. On the same day, our solicitor, Tedros Yabio, at the Family Court, secured interim orders for our long-suffering client to have contact with his children. This afternoon, our principal, Mr Mayek achieved a non-conviction, no further disqualification on a subsequent driving while suspended offence and a nominal fine of $500, for an offence that carries more than 10 penalty units. This was no mean feat but with courage, it happened. Going to court does not only require a legal representative who knows his stuff but also one who has the courage to fight for your rights. 08.01.2022 Section 501 strict character test of the Migration Act 1958 doesnt apply to refugees. The Federal Governments power to cancel visas, detain and deport non-citizens convicted of crimes for more than 12 months in prison does not apply to refugees. Justice Rares of the Federal Court of Australia ruled on the Christmas Eve that a refugee cannot be returned to their country of origin because they were recognised as a refugee in the first place and thereby deserving of continuing... protection. This is a ground-breaking precedent which will have huge implications for the government. 01.01.2022 What a wonderful week weve had! On Thursday, in a dispute between our client (whose deposit of well over $80,000 was forfeited to a vendor), and one of the major four banks, the Australian Financial Complaints Authority (AFCA)made a recommendation in favour of our client. This means that our client will be compensated the deposit lost as a result of the cancellation of the unconditional loan approval. Our principal, Maker Mayek, had the carriage of the matter. On Friday mor...ning, our solicitor, Tedros Yabio, successfully assisted our client at the Childrens Court, leading to her children being placed back to her custody by the Department. On Friday, our principal, Maker Mayek, successfully made an application at the Victorian Civil and Administrative Appeals Tribunal (VCAT) on behalf of our client (the tenant) for relief against forfeiture in a retail leases dispute against the landlord. As weve often said, it doesnt just require a solicitor who knows his stuff, but one with the courage and gumption to fight for your rights.
