23.01.2022 What do the Loch Ness Monster and statutory easements have in common? Well, nothing really. But they do share this same issue: whether they even exist. When it comes to Body Corporate Law, whether a statutory easement exists in favour of a lot owner or body corporate, much like the Loch Ness Monster, is hotly contested, and often misunderstood by practitioners in this area. The Queensland Civil and Administrative Tribunal recently heard an appeal from a lot owner that argued he should be able to install the compressor of his split-system air conditioner on common property because the legislation gave him a statutory easement to do so. The Tribunal disagreed and said that a statutory easement did not exist in his favour in that circumstance. Our body corporate expert Brendan Pitman explores this further in our recent blog.

19.01.2022 Thanks to the Institute for Glycomics for taking us on a tour of its facilities and highlighting the amazing research being undertaken right here at Griffith University’s Gold Coast campus. At MBA Lawyers we are proud supporters of the Institute and today we team up with Sanctuary Cove Country Club and Southport Sharks to raise money for men’s cancers. With 1.3 million new cases being diagnosed each year worldwide of prostate cancer we hope our contribution will help fund the Institute’s research, which aims to combat the poor levels of misdiagnosis by creating a more thorough and accurate diagnostic test to aid in the early detection and treatment of prostate cancer.

19.01.2022 Today we kicked off our third annual Health and Wellbeing Week at MBA Lawyers. We enjoyed a delicious morning tea from Fingers & Forks, followed by an inspiring session with clinical psychologist Cliff Battley Bully Proof on Harnessing the Power of Optimism. We then grooved into the afternoon with a Zumba class with Zumba with Shantelle. The team are also focusing on goal setting, sharing healthy recipes, and getting moving with a 10,000 steps challenge during the week.

16.01.2022 Lot owners breaching body corporate by-laws is a common problem that body corporates often face. MBA Lawyers recently solved this problem for a Gold Coast body corporate when our Associate Brendan Pitman successfully ran one of the first court cases in Queensland which resulted in an administrator being appointed to oversee the demolition of an unapproved established sunroom. 05.01.2022 Insurance companies could be forced to pay out thousands of dollars to business who were affected COVID-19 after today. Businesses, who purchased business interruption insurance were previously excluded from making COVID-19 related impact claims. However, today the NSW Court of Appeal rejected the insurance industry’s argument that policies did not cover COVID-19 losses. The decision comes after some insurers repeatedly expressed confidence to their shareholders that pandem...ic exclusions would stand, despite the fact that many referred to an expired Act of Parliament. 04.01.2022 Yesterday the Morrison government delivered its 2020-21 budget, promising significant funding towards family law and family relationship services. The main takeaways include: 1. $2.5m over two years from 2020-21 for federal family law courts to maintain specialised court lists for urgent matters arising as a result of COVID-19. 2. $132.1m over 4 years from 2020-21 to expedite the handling of family law matters and other matters in the Federal Circuit Court. ... 3. $4.8m has been provided for the Family Violence and Cross Examination of Parties Scheme, which helps protect victims of family violence in family law proceedings and $1.8m towards implementation of the National Domestic Violence Order Scheme which allows for nationwide registration and enforcement of state-made domestic violence orders. 4. $7.7m over 4 years from 2020-21 for works to improve the safety and security of the Rockhampton and Launceston Federal Circuit Court buildings.
