24.01.2022 What are "Letters of Administration"? If a person dies without leaving a valid Will, the Court may grant "Letters of Administration" to a person who would be a beneficiary of the deceased's estate. This is usually the deceased's spouse, parent, sibling, child or grandchild. If a person dies leaving a Will but does not name an executor, or the executor named is not able or willing to apply for Probate, the the Court grants "Letters of Administration with Will annexed". McAuliffe Legal is able to advise you on Will and Probate matters. We are based in Busselton and in Margaret River. Contact our offices on 97573300 to make an appointment. 23.01.2022 Is my ex de facto partner entitled to my superannuation upon separation? Currently in Western Australia, the law does not allow de facto parties to divide and redistribute superannuation. However, in dividing the parties' assets, an adjustment may be made by the Family Court in favour of either de facto party so that they receive a greater share of the non-superannuation assets if the other de facto spouse has greater superannuation entitlements.
