05.01.2022 The Property Council of Australia lodged a submission to the State Government outlining industry’s concerns with the Code of Conduct for SME Commercial Leasing Principles and provided six key recommendations ahead of the deliberations this week. On behalf of the industry they have asked the State Government to consider: 1. How a tenant’s qualification and reduction in trade should be calculated; 2. Flexibility to achieve mutually agreeable outcomes between parties on a case-...by-case basis; 3. Smaller landlords to be exempt from the Code’s conditions; 4. Lease termination and security restrictions not to apply to debts that existed before the current crisis; 5. Requested additional protections for landowners; and 6. Sought to avoid lease extensions which might conflict with contractual agreements.
