25.01.2022 DOES YOUR FAMILY TRUST DEED NEED TO BE AMENDED?? The New South Wales Government has made amendments to the Duties Act and Land Tax Act which will mean some property owners will incur surcharge Land Tax and Stamp Duty on their properties. The changes will affect people who utilise family (or "discretionary") trusts to own real estate. These entities are commonly used to hold property for asset protection reasons and income distribution benefits. The trustee of the trust has ...the discretion to distribute income generated by the fund to certain classes of beneficiaries. The definition of "beneficiary" is often very broad, leaving the trustee with the discretionary power to decide who should receive income. In recent times, the New South Wales Government has introduced additional stamp duty for foreign purchasers and also surcharge land tax for foreign owners of real estate. The definition now includes any potential foreign beneficiary under a family trust, which will trigger the additional payments. In order to avoid the additional land tax and stamp duty your trust deed will need to be amended to specifically exclude foreign beneficiaries. The Office of State Revenue has given trusts until 31 December to properly amend their trust deeds to documents these changes. McIntosh McPhillamy & Co are able to help review your current trust deed, recommend the required amendments and prepare the necessary documents. However, you will need to act soon as possible given the 31 December 2020 deadline. 22.01.2022 Tough new COVID-19 compliance measures for pubs New rules will be introduced to pubs across NSW that will limit group bookings to a maximum of 10 people and cap the number of customers inside a venue to 300 people following a concerning rise in COVID-19 cases. Tough new compliance measures will also see dedicated Hygiene Marshalls patrol venues to keep customers safe and ensure the mandatory implementation of a COVID-Safe plan. ... Any business found in breach of the public health orders will be held to account and could face a penalty of up to $55,000 and a further $27,500 penalty may apply for each day an offence continues. On the spot fines can also be issued. Liquor and Gaming NSW also have the power to enforce the following penalties: - first offence: $5500 fine or relevant penalty for breach of the Public Health Order - second offence: Business will be closed for one week - third offence (repeated and willful non-compliance): Shutdown for up to one month. At the end of the month we say goodbye to the incredibly respected and well loved Chris Nichols. Chris has been a pillar in our firm for the past 25 years and will be missed terribly as he ventures into retirement. Chris has been responsible for the majority of the firm's employment, commercial and litigation practice over the years. He has been a brilliant mentor for our junior so...licitors and is known for his incredible professionalism, attention to detail and candor. While we are sad to see Chris leave, we are excited to see Kelli Ennever step up in her new role as a director. Kelli moved to Bathurst in September 2018 after working as a Senior Associate at Marsdens Law Group. Since that time she has shown herself to be a remarkable lawyer who showcases a wealth of experience, knowledge and professionalism.
