25.01.2022 Today is World Elder Abuse Awareness Day Everyone in our community deserves to live in safety and free from abuse and intimidation. Elder abuse is often a hidden problem and anyone with grounds to believe an older person is at risk of abuse, neglect or exploitation should immediately contact the Ageing and Disability Commission (ADC).... NSW Ageing and Disability Commissioner Robert Fitzgerald, AM said too many older people are at serious risk of abuse and harm, even within their own family, home or community. As a society we must work together to end the abuse of older people by remaining engaged with them, valuing what they contribute to our lives and taking action if something does not seem quite right, Mr Fitzgerald said. Since being established on 1 July 2019 the ADC has received more than 1700 reports and enquiries relating to older people. Psychological harm was the most common form of alleged abuse reported to the ADC in relation to older people, with 751 cases reported to the ADC between 1 July 2019 and 30 April 2020. 25.01.2022 SUPERANNUATION Did you know that you do NOT own your superannuation? Your superannuation is held in a trust. The trustee of your super fund owns your superannuation. This means that if you die, your superannuation does NOT automatically form part of your estate and will NOT be governed by the terms of your Will.... So what can you do? You can make a binding death benefit nomination directing the trustee of your super fund as to where to pay your superannuation in the event of your death. However, be aware that: 1. Many funds do NOT allow members to make binding nominations. In other words, the fund retains the discretion to decide who it will pay your superannuation to on your death. 2. If the nomination is not signed by you in the presence of two independent adult witnesses then chances are it is NOT legally binding. 3. Most binding nominations expire after 3 years and need to be renewed. 4. You can generally only nominate your spouse, child or your estate. Please read the rules governing your superannuation fund carefully to ensure your nomination is valid. 5. If you wish to pay your superannuation to your siblings, parents, friend, charity or another non-dependent, then you can direct your superannuation be paid to your estate and then specify in your Will how the funds should be paid by your executor. For most of our clients, superannuation is their second largest asset. Accordingly, a legally binding nomination governing the payment of superannuation on death is essential. When it comes to superannuation, you MUST read the fine print. You also need to understand the applicable laws and common traps and pitfalls. 10.01.2022 Temporary changes to witnessing legal documents This afternoon, the Attorney General has approved new temporary regulations to allow lawyers to use video technology for witnessing legal documents including Wills, Powers of Attorney, Appointments of Enduring Guardian, Affidavits, Statutory Declarations and Deeds. Under the new regulation, a witness must see a person signing the document in real time to confirm the signature is legitimate, but now they can do so using video con...ferencing technology. The witness will sign the document, or a copy of the document, to confirm they witnessed the signature. This could be done on a hard copy that is scanned and sent to the witness or on an identical counterpart of the document the signatory signs. Traditional methods of signing and witnessing these documents remain valid while the regulation is in force. Where possible, it is always preferable to have legal documents signed and witnessed face-to-face. However, these measures will help anyone who is diagnosed with Covid-19 with signing documents without putting others at unnecessary risk. In addition to permitting video witnessing of documents, the regulations have expanded the list of persons who are permitted to witness the signing of a statutory declaration. At this stage, the changes are effective for 6 months and will cease operation on 22 October 2020. We are continuing to meet with our clients while maintaining safe social distancing.
