16.01.2022 On Monday the Fair Work Commission found Qantas is not obliged to pay personal leave entitlements to workers stood down due to Coronavirus. The Commission agreed with Qantas’ argument that these entitlements, including sick leave, carers’ leave and compassionate leave, are meant to protect the employee from lost income due to taking leave from work they are required to perform. It found where there is no such work to be performed, due to the employer lawfully standing the emp...loyee down, this income protection is not needed. Employees are still able to access other entitlements such as annual, long service and parental leave, as well as at half pay or without pay, during stand down.
