12.01.2022 Can the children’s right to spend time with a parent be suspended due to COVID-19? Recently I received a call from a mother regarding her ex-partner suspending time. The complaint was during a period when the children, both of whom are under ten years of age, were in my client's care, they were allegedly unreasonably quarantined due to the current Covid- 19 virus. Rather than contacting the mother and having a discussion with her, the father decided to send a message to the... effect that spent time arrangements will be suspended until the children want to once again resume seeing their mother. As can be expected, a responding email from the mother to her ex-partner was less than conciliatory. If only the first contact could have been the ex-partner asking to meet with our client to discuss the concerns. To unilaterally suspend the children’s right to spend time with a parent should only occur in the most drastic of circumstances. Surely it would be better to hold a conversation to see if the matter can be resolved.
