24.01.2022 Heartbreaking and so much respect for Brisbane father, Steve Peek. Steve flew to Sydney to give evidence at Andrews trial about how callous this system is and his battles over many years with Queensland Health trying to get his daughter Suli a legal product from her doctors at the Lady Cilento Hospital. Sadly Suli died unexpectedly and prematurley after being admitted to Lady Cilento Hospital last November for unrelated problems probably caused by medication shed been given... prior for gastrointestinal issues. And doctors insisted on withholding the cannabis and she died. Much respect also to Andrew for representing himself after legal aid would not fund his defence. Andrew sums up the situation "In Australia, its a disaster. The case of Suli Peek is a heartbreaker. A little girl with complex neurological issues and severe intractable epilepsy responded brilliantly to cannabis. She didnt seize in a year. She was having hundreds a day. She went to hospital for complications from drugs that doctors had given her, and they withheld the cannabis and she died. Its a coroners case at the moment. But, her dad came along and spoke about it. The doctors have adopted a spiteful attitude, which is completely unprofessional, let alone unethical. They have a spiteful attitude to cannabis. They dont want it to work basically. And theyre seeing evidence that pharmaceutical cannabis is about half as effective as quality herbal cannabis. Thats the bare facts of it. Andrews acquittal by the jury of all cannabis charges on the grounds of a medical necessity defence is a huge win for children and their parents. The jurys not guilty verdict shows that parents have justification for breaking these ridiculous laws by giving their child cannabis oil to save them from serious harm or death. But in doing so a lot of parents have already been charged or thousands more are still at risk of being charged with the serious offence of aggravated supply of a dangerous drug to a minor which carries maximum sentence of 25 years in prison and also risk having their child taken away from them by child services. The necessity defence is woven into our laws and is avaialble for all patients and parents to raise however legal aid wont fund not guilty defences and private lawyers, most of whom have been reluctant to even raise the defence would charge tens of thousands in legal costs. Its time state laws were changed across the country to protect patients and parents from being charged and prosecuted under these outdated and draconian laws.

24.01.2022 After Q Healths public briefing we will be protesting across the road at the executive building as there are no plans to change regulations to STOP police arresting patients and carers or to stop the criminal prosecutions of patients like Deb Lynch or parents like Jamie John Blake and his partner who are being sentenced in the Supreme Court on 10 December for the more serious charge of aggravated supply of a dangerous drug to a minor which carries 25 years in prison. While ...Continue reading

24.01.2022 We had a great show of support from the public wanting changes to QLDs draconian cannabis laws on the last day of our petition signing in Queen St, Mall yesterday. RALLY REMINDER: Please show your support and come along to the RALLY at QLD Parliament House on Wednesday 14 Nov. The online-petition & paper version sponsored by Michael Berkman - Greens MP for Maiwar will be tabled in QLD Parliament about 9.00 am on the morning of the rally if youd like to be present in Parl...iament. We want Annastacia Palaszczuk MP Jackie Trad Yvette DAth for Redcliffe Mark Ryan MP Steven Miles to change unjust criminal laws to STOP police arrests of ALL patients, carers and other cannabis consumers. We also want permits to grow up to 6 plants, licences for not for profits and microbusinesses, and other changes so ALL GPs and specialists in QLD can prescribe cannabis without needing approval from QLD health bureaucrats. HOW YOU CAN HELP! Please keep sharing the rally flyer through your networks. If you have a printer please download, print and circulate the flyer in your local area. Send us a message if you can help hand out flyers in the CBD early Wednesday morning or help with set up at Parliament House about 10.30. TIA and a huge thank you to everyone who has been helping us with this campaign.

22.01.2022 Health Canada approvals surge while in Australia, the Liberals TGA access system continues to fail patients In 3 months Health Canada added more than 34,000 registered medical cannabis patients that can either be obtained cannabis directly from a licenced producer of the patients choice or patients grow their own cannabis. Canada now has more than 330,000 registered patients and on 17 October the recreational use of cannabis will also be legal across Canada. ... In Australia thhe TGA have approved only 657 Category B applications from July to Sept (see link below). July - 188 August - 231 September - 238 NOTE: The new online system for doctors started in July. Cat B Approvals do not equal the number of patients that have actually been supplied cannabis due to the following: * approval numbers also include repeat applications for the same patient as an approval can be for 1 month or up to 12 months * some patients may have a number of separate approvals for multiple products * a doctor may have Cat B approval but state approval is pending or was rejected * the patient was approved but was not supplied cannabis because they could not afford it * patients have been approved but if they change doctor or supplier their new doctor needs to put in a SAS application *sadly some patients with TGA approval have passed away waiting for state approval * approvals are mostly for CBD products, lesser approvals for THC oils and very few approvals for dried cannabis bud * Liberal government is still defying the Senate motion passed in June 2017 and is not allowing access to the bulk imported cannabis via Category A (TGA approval not required) - any patient using Category A needs their doctor/pharmacist to apply for an import licence however the Liberals are allowing Australian companies to export their cannabis. * numbers do not include cannabis supplied through research trials or the 42 TGA authorised prescribers who are mostly connected with reseach trials * Access to cannabis and cannabinoids have been available through the SAS since 1989 and could always be imported under the Customs regulations. * Since 1992 when the TGA received the first known medicinal cannabis SAS application there have been 1,174 approvals in total. * QUEENSLAND changed laws in December 2015 to allow doctors to obtain state approval for supply of cannabis via the SAS but to date QLD Health have only approved 50 patients. * Since June 2016 Queensland specialists with SAS B approval treating terminally ill patients or patients with MS, chemo induced nausea and children with epilepsy have not needed state approval. https://www.tga.gov.au/access-medicinal-cannabis-products-1

20.01.2022 Adults in Canada can now buy cannabis oil, seeds and plants and dried cannabis from licensed producers and retailers, possess up to 30 grams of dried cannabis in public, or its equivalent, and grow four plants per household. The medical use of cannabis was legalised in 2001. Government officials also announced they will present legislation intended to fast-track pardon applications of people who have been convicted of possession under 30g (one ounce). There are currently s...ome 500,000 Canadians with existing criminal records for possession. Information has been sent to 15m households about the new laws and there are public awareness campaigns. The prime minister has argued that Canadas nearly century-old laws criminalising use of the drug have been ineffective, given that Canadians are still among the worlds heaviest users. He said the new law is designed to keep drugs out of the hands of minors and profits out of the hands of criminals. The federal government also predicts it will raise $400m a year in tax revenues on the sale of cannabis. https://www.bbc.com/news/world-us-canada-45806255

17.01.2022 One of the highlights of the rally was Dr. Deb, Debbie Waldron speaking with a group of school children on an excursion to Parliament House. Their teacher had bought them out to watch our rally and had explained to them that it was everyones democratic right to use "Speakers Corner" as place to gather for peaceful protests about laws they wanted Parliament to change. The kids were amazing and asked very sensible, relevant questions and couldnt understand why sick people were made criminals for using cannabis for medicine. Their teacher was also amazing as these kids learnt an invaluable lesson about freedom of speech, public advocacy and active citizenship.

16.01.2022 Please come along to the rally on the 14th November at Queensland Parliament House and show your support for cannabis law reform in Queensland. We will be in Queen St Mall Brisbane TOMORROW (Sun 4th Nov) collecting signatures for the paper version of the petition. It will be tabled with the online petition in parliament on Wednesday 14th November.

11.01.2022 Thank you and so much respect for Steve Peek for being a voice for so many parents and their children who have been denied access to cannabis and treated as criminals by this callous system in Australia. On Monday morning the 26th Nov this week I flew to Sydney at the request of Andrew K to attend his court case as a witness. My testimony was how medicinal cannabis had such a good benefit for Suli and how the system comprising of Federal and State governments and the Qld Hea...lth system failed my daughter by refusing to prescribe a legal MC product for her and the harm caused by the times she was denied access to MC in the hospital and threatened with arrest. The horrendous side effects she suffered from the pharma medications prescribed to her in lieu of MC which among other things all combined to contribute to her premature death. The judgement of not guilty on all counts was for me a bitter sweet moment. Sweet that justice was served but bitter that Suli was not here to see it and her death may have played a part in the result. Hopefully this is the start of retribution for Suli and others like her who have died and are still suffering needlessly. May these people responsible for this travesty all hang their heads in shame for what they have done and are still doing. A perfect example is the admission by the Director General of Qld Health that their approach to MC was flawed. Well that was big of you to admit that but what are you doing to rectify the problem. Every politician and Bureaucrat in this country is in some way responsible because you could ALL do more. One day in years to come people will look back on all this and say why did they do this to people and make them suffer and for what. See more

10.01.2022 Young Dad in the Supreme Court charged with supply cannabis to his 5 year old son who has autism needs your support - please help anyway you can. Jamie and his partner were at the rally today and have been charged under Queenslands draconian Drugs Misuse Act 1986 - cannabis is scheduled in the Drugs Misuse Regulations as a dangerous drug. Jamie and Stephanie face sentencing in the Rockhampton Supreme Court on 10 December on charges of produce and possess a dangerous drug... (both max. 20 years prison) and the more serious charge of supplying a dangerous drug to a child (max. 25 years in prison). Overseas cannabis is available for children with autism. Legal Aid, like they do with all cannabis clients, will not fund a not guilty defence which was Jamies instructions and his wishes to raise necessity, justification or excuse defences. They havent challenge any of the evidence at committal or rather lack of evidence of supply - no certificate of analysis as the police did not seize any oil. Legal Aid have now withdrawn 5 weeks out from Supreme Court sentencing. A private Barrister wants $14,000 up front by 27 Nov - https://www.gofundme.com/jamie-blakes-legal-costs Please also contact the Attorney General Yvette DAth for Redcliffe, as she is the Minister responsible for the Drugs Misuse Act and ask her to drop these charges as it is not in the public interest. Our petition asks for the schedules in the Drugs Misuse Regulations to be amended to provide exemption from criminal charges for all patients, carers and other cannabis consumers so that parents like Jamies are not arrested in the first place.

10.01.2022 Reminder: submissions due Monday 7 January - Parliamentary Health Committee Inquiry into the QLD Governments proposal to repeal the Public Health (Medicinal Cannabis) Act 2016. The Bill will repeal 140 pages + of unecessary legislation that has duplicated federal TGA processes at a state level for doctors prescribing Schedule 4 Cannabidiol (98% CBD) and Schedule 8 cannabis (dried bud) and tetrahydrocannabinols (products containing THC) supplied from federally licenced com...panies and importers. Prescribing and dispensing S4 CBD and S8 cannabis and THC will be regulated back under the Health Drugs and Poisons Regulations 1996 * * Doctors should not need approval from QLD Health but will still need to go through the SAS * * TGA manufactured products on prescription are expensive and unaffordable for most patients While the Premier and Cabinet will be able to make new regulations or amend existing regulations without the need for an amending bill to go through parliament this proposal does not go far enough:- * There are no plans to provide exemptions for patients and parents growing and possessing their own cannabis * No plans to allow for state cultivation and manufacturing licences or supply cannabis through dispensaries Address for submissions: Email: [email protected] Post: HCDSDFVPC, Parliament House, George Street, Brisbane, Qld, 4000 Fax: 07 3553 6699 https://www.parliament.qld.gov.au//current-in/HealthOLAB18

10.01.2022 PLEASE EMAIL THE DPP TODAY Ask for all charges against Jamie & Stephanie to be withdrawn. Michael Byrne QC, Director Of Public Prosecutions: ... [email protected] cc: Yvette DAth, Attorney General: [email protected] See the update for more details or you can use this form letter below. Dear Mr Byrne, Re: Cannabis Prosecution - NOT IN THE PUBLIC INTEREST - Jamie Blake and Stephanie Mackay, Rockhampton Supreme Court, 10 December 2018 Please exercise your discretion under the DPP Guidelines and withdraw all charges against parents Jamie Blake and Stephanie Mackay. It is unfair to continue with this prosecution when valid legal defences are available but Legal Aid would not fund their defence and they are unable to afford the costs of a private lawyer to defend these charges. Jamie and Stephanie are hard working, caring and loving parents and should not have been charged under these draconian laws in the first pace. They have suffered as a family and also financially as Jamies Blue Card was cancelled along with contracts installing sale shades in pre-schools. If the DPP continue with the prosecution, it is unlikely QCAT will reinstate Jamies Blue Card even if a no conviction is recorded. Criminal laws should not be used to punish loving and caring parents and their children who have been failed by the health system. Police and prosecution resources should only be used to pursue crimes worthy of prosecution, and Supreme Court resources should only be used for serious offences such as murder, rape and other serious offences and NOT against parents who were doing what any loving parent would do if put in the same situation. ANY reasonable minded person in the community, would agree that it is NOT IN THE PUBLIC INTEREST to proceed with the criminal prosecution of these parents. I look forward to you acting in the public interest and withdrawing all charges. Kind regards https://www.change.org/p/queensland-attorney-ge/u/23709209

05.01.2022 Queenslands draconian drug laws are unfairly being used by police to target patients, carers and other consumers of cannabis with dire consequences for peoples health, their families, employment, education and travel. Ms Lynch said: The objective target of the Act was drug traffickers however over 90 per cent of cannabis arrests are patients, carers and other consumers, including me, she said. Having to go to court for using this drug which helps keep me alive is so unfa...ir and the stress is killing me and others. The medicinal cannabis laws, we believe, have failed patients by giving excessive powers to Queensland Health bureaucrats who have obstructed access from other suppliers because of commercial agreements with GW Pharmaceuticals (CBD, 30 children) and Zynerba (synthetic CBD/THC). Ms Lynch said she wanted the government to amend the law to ensure police stopped arresting all cannabis consumers and to ensure those who needed cannabis as medicine should have fast-tracked access. The petition was tabled a day after the state government introduced a Bill to repeal the Public Health (Medicinal Cannabis) Act 2016 so medicinal cannabis will be treated the same as other schedule 4 prescription medicines and schedule 8 controlled drugs. Please also sign our change.org petition to the AG, Police and DPP to STOP the arrests and prosecutions! https://www.change.org/p/queensland-attorney-general-yvette

03.01.2022 Queensland Cannabis Rally - Parliament House This event has been organised by the MCUA and MCAG (see links below). The online petition and paper petitions sponsored by Michael Berkman - Greens MP for Maiwar will be tabled in QLD Parliament on 14 November. We are calling on the QLD Premier and Cabinet to make some simple changes to regulations before Christmas. These changes can be made at a weekly cabinet meeting and do not need a bill to go to parliament.... Patients and families all over Queensland are being harmed by these unjust laws and need change NOW - not years away. If you want this to happen we urge you to try and be present on the day to show VISIBLE PUBLIC SUPPORT for the Petitions being presented on 14/11/2018. It is important that we get a good turn up at this event. Otherwise it will look like no one in Qld really wants an end to the current UNJUST situation that puts cannabis out of reach for too many. There is still time to collect signatures BUT forms MUST be returned by 9th November to be included in the count. A link to petition will be posted in the discussion thread here. We are requesting the Premier and cabinet to make a number of changes including urgent amendments to: 1. Drugs Misuse Regulations 1987, Schedules 2 and 3: criminal provisions around cannabis plants, cannabis and cannabinoids not to apply to consumers. AND 2. Health (Drugs and Poisons) Regulation 1996, 270A: remove restrictions on the cultivation/production, possession and supply of cannabis plants, cannabis, cannabinoids; and make new regulations to allow consumers to cultivate 6 plants in flower at any one time and possess cannabis, upon the person accepting all risks and responsibilities for usage and storage of their cannabis; and licences for micro businesses and non-profit-organisations to produce affordable cannabis for supply within Queensland. Please do your best to support this event. The changes being proposed are DO-able but without VISIBLE PUBLIC SUPPORT in large enough numbers, it wont happen ... We look forward to seeing you on the day. Feel free to bring a placard / sign with your message. Thank you in anticipation of your support https://www.facebook.com/groups/mcuaa/ https://www.facebook.com/medcanadvisorygroupqld

02.01.2022 ACT Labor backbencher Michael Pettersson introduced a Bill on Wednesday in the ACT Parliament to legalise cannabis for personal use claiming overwhelming support for his bill. It would mean adults possessing up to 50g of cannabis or four cannabis plants would no longer be committing a criminal offence. But there are question marks over the legal barriers to enacting the bill, with concerns it could be overridden by Commonwealth laws.... Mr Pettersson said he would introduce the bill the next sitting week after making technical amendments based on submissions to the draft bill
