14.01.2022 Complying with Family Law Orders COVID-19 In recent days there has been a growing level of uncertainty about whether or not Orders made under the Family Law Act need to be complied with in the world of social distancing and other restrictions on movement that we are currently living in. The legal position is that court orders must be complied with unless there is a reasonable or lawful excuse. Under the New South Wales government restrictions published in the New South Wal...es government Gazette on 30 March 2020, there are significant and enforceable restrictions on movements by individuals and assembling in public in groups of more than 2 people. There are specific exceptions which allow separated parents a degree of certainty about complying with their obligations under court orders or any private agreement. Importantly, there is not a requirement for children to move between houses of separated parents or other family members under a court order or parenting plan. The reasonable excuses to not comply with the restriction on movement includes for children who do not live in the same household as their parents or siblings or one of their parents or siblingscontinuing existing arrangements for access to, and contact between, parents and children or siblings. Accordingly if you or someone you know is uncertain about their obligations in complying with the COVID-19 restrictions and also complying with the practicalities of having children move between 2 households, there is no reason why existing arrangements (either court ordered or otherwise) are not able to continue. If you or anyone you know needs family Law advice including commencement of urgent court proceedings, our firm will be remaining open during the period of any restriction on movement (with restrictions on the number of clients who can attend our office at any one time) and we will be open to provide advice and assistance to either you or anyone you know. 07.01.2022 NEW ALERT FROM THE NSW Government The NSW Government announced yesterday the new stamp duty concessions for first home buyers for all contracts entered into from 1 August 2020 for newly built homes and vacant land. They are; 1. Cap on stamp duty exemption for newly built homes has been lifted from $650,000 to $800,000. There is then concessions between $800,000 and $1,000,000.... 2. Cap on stamp duty exemption for vacant land has been lifted from $350,000 to $400,000. There is then concessions between $400,000 and $500,000. Please note these new rules are only in place until 1 August 2021 and only apply to newly built homes and vacant land. The current cap of $650,000 will continue to apply for first home buyers of existing houses. There is also no change to the $10,000 new home grant for first home buyers purchasing a new property under $600,000 or a house and land bundle of up to $750,000 combined.
