25.01.2022 In Australia, two young people (under the age of 18) are reported missing every hour. #InternationalMissingChildrensDay raises awareness for the phenomenon of missing children globally, with 24 countries now recognising this as a significant issue, we are working together to bring these children home. Some of these missing children are taken by the people they trust the most; a parent or family member. Unfortunately many people believe that if children are with a family membe...r they shouldn't be considered missing or at risk. Parental child abduction can have extremely harmful physical and emotional effects on the children who have been abducted. With extreme cases involving children being lied to and manipulated and told that the family left behind no longer love or want them. Family or parental abduction often occurs in highly stressful and emotional circumstances. For some it is a desperate attempt to remove a child from risk of a domestic violence environment. Men's health, and mental health in particular, is a big part of our focus here at Men's Legal Service because we are quite often meeting people for the first time when they are going through one of the worst times of their lives. That's a pretty big thing for both our clients, and our staff. Did you know that we have a referral list for our clients full of services that may be able to assist? We're also lucky enough to be socially networked... with a fantastic group of men's groups around Australia, & the world. If you're worried about the toll life is taking on your mental health, reach out. We know it's hard, but sometimes talking to someone distanced from your situation is all you need. As well as talking to professionals in times of crisis, we encourage making your mental health a priority as you do your physical health. Meditation is a great way to get in touch with yourself, & contrary to what social media says, you don't have to go to expensive wellness studios, or climb a mountain for solitary meditation, you can meditate in your pjs on your bed- anywhere that's comfortable & you can be alone. 22.01.2022 If you are the subject of a domestic violence order, abide by its conditions. It is a criminal offence to breach an order. If the order specifies that there is ‘no contact’ then that means any contact with your former partner other than via your solicitor. That includes: ... Contacting your partner by phone, email, text message, social media or other method. #MensLegalService Asking other people (other than your solicitor) to pass on messages or things. Even if your partner makes contact, do not breach the terms of the domestic violence order.

When it comes to deciding what to keep, remember, more is more because you can't be sure what will be relevant until your case goes to court. But what sort of information should you be keeping? Marriage and birth certificates. if these are from overseas and in a foreign language, you will need certified copies and translations All court documents and note the date they were received by you A list of... important dates including when you started living together or were married, birth dates of children, any real estate or major purchases, any dates of violence or threatened violence, date of separation, contact dates and anything of importance that was said, hearing dates, court dates, etc. Up-to-date details and contact information for any important witnesses you may need to call Photographs, videos, emails, texts Copies of all correspondence Bank statements, receipts, insurance documents, and any documentation related to property #MensLegalService #FamilyLawAustralia

16.01.2022 The law gives the Child Safety Department the power to remove children from home. This can be done by the Office of Child and Family Official Solicitor via an urgent application in the court, seeking a temporary assessment order or a court assessment order. These orders allow Child Safety to investigate and have custody of the child without the parent’s consent. ... The purpose is to determine if the child needs protection. If that is found to be the case, the Director of Child Protection Litigation will make an application for a child protection order. A child protection order can be for up to two years, or a longer term guardianship order if the child is in need of long-term care. The chief executive will have guardianship of the child until the age of 18 under a long term guardianship order. A ‘child in need of protection’ is a child who: has suffered significant harm is suffering significant harm is at unacceptable risk of suffering significant harm in the future, and does not have a parent able and willing to protect them from that harm. #MensLegalService
16.01.2022 The police will deliver a copy of the actual domestic violence order application to you. Read it carefully because it will explain when and where you have to go to court. At the point of being served, you have several options: ... 1. Consent to the domestic violence order being made, which can only be done if you agree with the order in person, through a lawyer or in writing. 2. You have the option to agree to an order being made without admitting to the facts. This is called ‘consenting without admission’. 3. Ask for the proceedings to be adjourned so you can get legal advice. 4. Oppose the order. If this happens, the aggrieved will be given a hearing date by the court. 5. Offer an undertaking to the Court that you will not make contact with your partner, in lieu of a domestic violence order. You do not have to sign a domestic violence order when it is served on you. Your first step should be to seek legal advice. Not all domestic violence orders are equal, and your legal advisor needs to be aware and involved. #MensLegalService
14.01.2022 Here's an example from our Men's Guide to Family Law (available as a free download from out website). John and Mandy separated. Mandy had a #domesticviolence order served on John, which John signed when the police delivered it. After four weeks (when the domestic violence order was still in place), Mandy messaged John and offered him the opportunity to see his children. John responded that he would like that and asked when.... This breached the domestic violence order. Mandy reported the breach and John was arrested for the breach, and spent the weekend in the watch house. What should John have done? He should have sought legal advice immediately after the initial contact from Mandy. His lawyer could have organised the time with the children without breaching the order. Epilogue: Once this matter was heard by a Magistrate and the sequence of events known, it was thrown out of Court. However, John still endured the distress of being arrested and imprisoned. #MensLegalService #FamilyLaw

Start a todo list of all your personal admin and keep it somewhere visible- like next to your computer screen- and allocate some time in your diary once a week or fortnight to make those appointments. Even if it means taking 15 mins out of your lunch break. #MensLegalService
10.01.2022 While this rule does apply in many other countries, there is no 50/50 rule in Australia. We have no specific mathematical equation for division of assets and this is up to the discretion of the Courts using the four step process of asset division. #MensLegalService

This decision may be one that neither party is happy with. The final part of a #FamilyLaw Court case is called the trial. In the Federal Circuit Court this is called the final hearing. But how often do we stop to consider the impact that our lives are having on the mental health of the youngest members of our family? Infant Mental Health refers to the development capacity of infants and young children (from pregnancy to age 3) to experience, express and regulate emotions; to form close and secure relationships, and to explore... their environment and learn (AAIMH.org). If you're in an unhappy relationship, in the midst of a separation, or even forget you have a baby in the room during heated conversations, please take the time to research and consider the effects that this could be having on your young children.
