17.01.2022 Legal Aspect of your Website If you are running a small business, you probably have a website or are thinking of creating one. Your website provides a simple and easy way to communicate with your customers about your business and what value you can offer. However your website can also have risks, unless you have proper terms and conditions of use (Terms & Conditions) which visitors must adhere to and which restrict your liability. What is your liability if someone relies on... something they have seen on your website and they suffer a loss as a result? For example, what happens if a competitor takes content from your blog, your website or tries to take your ideas? In order to manage the risk you should include your Terms & Conditions that visitors must agree to when visiting your website. This will also enable you limit your liability to the extent the law permits, protect your intellectual property and enhance your customer’s expectations. Under Australian Consumer Law (ACL), if you are selling goods and / or services through your website, you are required to clearly set out your business’ service standards on your website. 15.01.2022 The government will attempt to pass an amendment to increase manslaughter sentences to 25 years and create a new homicide by firearm offence. This new offence is intended to dissuade men who kill their female partners, and comes in response to a series of high-profile cases in which killers escaped murder convictions by claiming they shot their victims accidentally and received lighter sentences after being convicted of manslaughter. The cases being: Bikie Brandon Osborn ...was jailed for nine years in 2017 after he killed his girlfriend Karen Belej by putting a loaded gun to her head and pulling the trigger. He claimed he thought the weapon would not fire and escaped murder charges. Nelson Lai was sentenced to 9 years in prison for manslaughter in 2015 after claiming he did not know the gun he used to kill his girlfriend Rekiah O’Donnell was loaded. In 2014, Mehmet Torun received a minimum five-year manslaughter sentence for killing his girlfriend, Kara Doyle, after saying he did not know the gun that killed Ms Doyle was loaded when he pointed it at her head. The new offence will carry a maximum penalty of 25 years’ imprisonment and a standard sentence of 13 years, in line with other forms of manslaughter including child homicide and industrial manslaughter. 14.01.2022 When can employees be stood down without pay? Employees who are stood down without pay remain employed for the period of the stand down. Under the Fair Work Act, an employee can only be stood down without pay if they cannot be usefully employed because of a stoppage of work for any cause for which the employer cannot reasonably be held responsible. Whether the option of standing down employees is available in circumstances relating to coronavirus is very fact dependent and an... employer should exercise the option cautiously. The employer must be able to demonstrate that: there is a stoppage of work the employees to be stood down cannot be usefully employed (which is not limited to the work an employee usually performs) the cause of the stoppage must also be one that the employer cannot reasonably be held responsible for. If an employer unlawfully stands down employees without pay, the employees will likely be able to recover unpaid wages. Employers cannot generally stand down employees simply because of a deterioration of business conditions or because an employee has coronavirus. Enterprise agreements and employment contracts can have different or extra rules about when an employer can stand down an employee without pay. Employers should consider whether their obligations are impacted by any applicable enterprise agreement, award, employees’ employment contracts or workplace policies. See more

13.01.2022 Contesting a will - In Victoria, if a person has been left without adequate provision from a deceased estate, they may be able to contest the Will. Such an action is called a "Testators Family Maintenance Claim", or "TFM claim". In Victoria, you may contest a Will if you are an Eligible Applicant; and You believe that you have been left without adequate provision. The Court considers a number of factors when ascertaining whether an estate has made adequate provision.In Victor...ia, the time limit in which to contest a Will is 6 months from the date probate has been granted to the executor(s) of a deceased estate, pursuant to Section 99 of the Administration and Probate Act 1958 (VIC). A claim may be brought beyond the 6 month period upon application to and approval from the Supreme Court. It is up to the claimant to show that the estate would not be prejudiced in bringing a claim out of time and the reasons for the delay in making the claim. However, it is imperative that the estate has not been distributed after the expiration of 6 months and before the claim has been filed with the Court. Conveyancers are non-lawyers who are licensed to perform a part of the legal work associated with a real estate transaction, so long as it does not go beyond conveyancing work, some have limited licences or restrictions where they cannot do all the work required. If a dispute occurs conveyancers are duty bound to refer a client to a lawyer for ...further assistance that’s why they say or advertise they retain a lawyer for all legal work but this is often not the case. Unfortunately, on some occasions they offer legal advice without referring the individual matter to a their lawyer for review or advice as each matter is usually factually different. The need for licensed conveyancers to refer clients to lawyers for complex matters and issues that take the matter beyond conveyancing work renders the licensed conveyancer an expensive middle-man when the total cost of the transaction is billed as their lawyer doesn’t work for free! Also in many cases wherein there is a dispute we can resolve the issue quickly and often at no additional costs as we are licensed and qualified to give legal advice, unlike conveyancers. 05.01.2022 The state's $328 million of unpaid fines will allegedly be whittled away once Fines Victoria’s new system goes live over the weekend. The software system for collecting court, parking, red-light camera and speeding fines failed on a massive scale in 2017, leading to a backlog of infringement notices the Department of Justice couldn’t enforce and a $328 million hole in the state budget. Reminder notices will progressively be staggered at about 700 a day and be sent out for abo...ut140,000 fines which have been outstanding in the magistrates and county courts. The issue is being blamed on a software package called VIEW, bought off the shelf from British company Civica in a $103 million contract. VIEW was originally designed to enforce London’s congestion charge. o shortlist The backlog resulted in a reduction in the number of cases before the Magistrates Court, leading to concern that once the system was online again, the court would be hit with an influx of offences. Criminal listings dropped by 7 per cent across the state, in the Melbourne Magistrates Court alone there was a 21 per cent decline and CityLink fines reduced by 75 per cent and speeding fines by 38 per cent.
