23.01.2022 In this side-snippet from a recent Webcast I did for Television Education Network Pty Ltd, I reflect on the plight of the mythical Oomidoodle Bird which Fryberg J compared to that of #SMSF members in the Queensland #superannuation binding death benefit nomination case of Donovan v Donovan. 22.01.2022 In this video I recount a couple of examples of extreme funeral planning. Whilst that level of planning isn’t how I personally roll, having #estateplanning sorted rather than leaving a less for loved ones is I think a basic courtesy.

21.01.2022 SMSF often have #realproperty and other lumpy assets that need to be removed from the #SMSF on the death of a member. However, unless carefully structured, an in specie transfer will attract #stampduty or, in some circumstances double duty. In this video, I discuss my recent success in transferring property from SMSFs (including from interposed unit trusts) to discretionary trusts without incurring duty liability. Its an area where #expertadvice is necessary.

20.01.2022 Weve had a great month for #landtax refunds for clients who have lived in #trust property as their principal place of residence. These refunds cover the last five years, so are typically in the tens of thousands of dollars and very #happyclients who receive the #goodnews. If in doubt, it may well be worth a call to see if theres any opportunity for a refund. #tax

19.01.2022 Before 2017, a member when they died could leave all their super pension to their spouse in a tax free environment. In 2017 the max they can leave in there is the $1.6m (as increased or decreased depending on their tax free pension balance) As such members with balances north of $1.6m need to update their estate planning if they havent done so already to make the excess is properly dealt with. I touched on this in our recent webinar Estate Planning in the Time of Coronavirus Link to the full recording in the comments.

16.01.2022 In this clip taken from the recent Merthyr Law Estate Planning in the Time of Coronavirus Webinar (link to full recording in the comments), Kieran Hoare reflects on some old school #estateplanning when he first started practicing where the patriarch ruled the roost and the will was read out when they passed, to the more modern approach of inclusiveness, dialogue and discussion.

15.01.2022 If a testator leaves an asset to a #charity under their Will, did you know that the estate is liable for the #cgt capital gains tax based on the market value of that asset at death? If you know of someone who has done that, talk to us, as there may be other options and we may be able to arrange a tax deduction with the #ATO. I talked about this in Merthyr Laws webinar #Estateplanning in the time of Coronavirus (link to full webinar in comments).

15.01.2022 Lawyers love DIY Wills because we make much more money from the fight than from doing the Will. In this video (part Merthyr Laws webinar #Estateplanning in the time of Coronavirus - link to full recording in comments) I look at DIY or post office Wills its not that theyre wrong, its just that people dont know the potential pitfalls. 13.01.2022 In this video I reflect that #2021year is flying by, before I’ve even got onto seriously #planningahead. Whilst #budget2021 is unlikely to include nasty surprises, this June 30 will be the last before a post-election (austerity) budget is handed down. As such, I’m asking people to consider #EOFY strategies now such as #restructuring for land tax and utilizing the potential June/July $430,000 non-concessional contribution bring forward limits and #cgt concessions to transfer property to #smsf as the clock is ticking (p.s #lawyers’ #quotes get more expensive the closer we get to 30 June).

13.01.2022 In this side-snippet from a recent Webcast I did for Television Education Network Pty Ltd, I ruminate that #superannuation practitioners would be well served taking the Binding out of Binding Death Benefit Nominations so they’re not seen to be inadvertently giving #legaladvice and leaving themselves open to potential #negligence suits. Link to full Webcast series on Managing Super and Death: A guide for Non-Super Experts in comments. #accountants #financialadvisors #SMSF #estateplanning

08.01.2022 The new Queensland Advanced Health Directives which must be used from 30 November 2020 ask much more existential questions than the existing version including what is important to me?’ and what worries me about my future?.
