23.01.2022 The Retail Premises Lease in Victoria When you are in business or you decide to go into business one of the most daunting experiences is finding your business address and entering into a lease with the landlord. If you are a sole trader the lease will be in your personal name and if you have set up as a company then the lease will be in the name of the company and more than likely you will be required to guarantee the performance of your companies obligations personally.... 23.01.2022 Well here is the news. A worker sacked for a positive drug test has had employment reinstated by Fair Work Australia. Decision A Sydney Trains customer service attendant admitted to smoking a joint however FWA Deputy President Sams noted that the drug test only recorded a THC result over 50 ug/l so an employee that recorded under the 50 limit could walk off scott free. 22.01.2022 Verification of identity and e-conveyancing Today I am discussing the need for Verification of identity and e-conveyancing. To reduce the risk of property fraud, states across Australian are introducing verification-of-identity (VOI) legislation for transfers of property. It also compulsory for property sales over $2m in Victoria. The VOI legislation applies to companies and people who are buying, selling and transferring property within WA, SA, VIC and NSW. The legislation is: (b)to replace the requirement for a tier one association to lodge a copy of its financial statements for each financial year with a requirement to submit an annual statement. 18.01.2022 For contracts of sale of real estate worth $2M or more entered into from 1 July 2016 new property rules state that all purchasers of such real estate must withhold 10 percent of the purchase price unless they are given a clearance certificate by the vendor. Vendors of such property who are not foreign residents need to apply for a clearance certificate as soon as possible. 18.01.2022 I had a call today about the changes being made to our banking laws. APRA our bank and finance regulator is concerned about the volume of lending and has directed that the banks increase their liquidity from 17% to 25%. The consequence will be banks loose 8% of their money to lend. The outcome is either less capacity to lend and make money or increase lending rates. Mmmm what do you think will happen?

16.01.2022 Back in the day when we did conveyancing settlements we would get all the paperwork sorted and then spend hours on the phone waiting to talk to a bank clerk to book settlement. We would then trot along with all our paperwork exchange this for that and jobs done. So I have now completed my second Pexa electronic settlement and it looks like the future holds good save for personal stress as I wait for the banks to do their stuff online. This last one was not signed off by the p...urchasers bank until 2 minutes before settlement and the purchase solicitor was on the phone trying to find out what was the problem. Electronic settlements mean that no one actually turns up and the registration of the purchaser at the titles office become nearly immediate. The issue of fraud is reduced because we ID everyone and the transfer is prepared and signed by the Purchaser solicitor online. So apart from not being able to talk to anyone and not having to attend a settlement personally this new system looks like it will be OK. I am also happy as I can pass on cost benefits to our clients and deal with the whole transaction via email and online - Its a brave new world. 14.01.2022 Do you rent a commercial property as the Landlord or the Tenant you need to know the latest. VCAT has just issued a directive to advise that if a Landlord is required to make good issues with respect to their property because essential safety measures require fixing. This could be a structural requirement from local council, a fire brigade make safe order or the like. Then the Tenant cannot be held accountable for that cost. 06.01.2022 New Building Laws - Have you ever found yourself looking at a new building contract and wondering what it all means? Next door to my place here in Silverwoods ...a new home is being built and I went to have a chat to the painter and walked inside to see that the concrete slab already had hairline fractures. I dont expect the owner will find out as tiles or carpet will be overlaid until one day when there is a major earth movement. But the issue of building construction and the rights of the owners have long been difficult issues to resolve in Victoria.
