25.01.2022 NSW State Nomination update - Invitation rounds will commence shortly for subclass 190 visa nomination. In line with Home Affairs' direction, we will only invite applicants currently in selected health, ICT and engineering occupations, and who currently reside in NSW.



25.01.2022 South Australia State nominations - SA will follow most other states and now send an invitation to apply for State Nomination. An invitation to submit an online application for state-nomination will be sent to prospective applicants with EOIs that meet Commonwealth and South Australian priorities. The Government of South Australia will publish state nomination requirements on 27 August 2020. From 31 August, South Australia will commence reviewing EOIs and sending invitations to submit an online application.

23.01.2022 Victoria State Nomination - In line with other states Victoria will open their Nomination program for a period. To be eligible for Victorian visa nomination (subclass 190 and 491) you must: be currently living in Victoria, and be currently employed in Victoria (minimum six months), and work in a highly skilled occupation in health or medical research, which supports Victoria’s economic recovery and/or health response.

22.01.2022 So, what has been happening in the Skilled Migration Program? COVID-19 has had a significant impact on the skilled migration program on so many fronts, from: - Those struggling to source their documents and evidence in their own countries, to Those trying to get their Skills assessed or complete an English test, to Those waiting anxiously to receive an invitation to lodge a visa, or Those who are towards the end of the process needing to complete their medical che...cks or get their police clearances For those lucky enough to have a visa granted but are unable to get on a plane give the border closures is proving beyond challenging, From April 2020 the number of invitations issued by the Department of Home Affairs has slowed to a trickle and is currently at 170 invitations per month for the subclass 189. For most though, State Nomination is required but given the delay of the Federal budget from May to October 2020 State nominated subclass 190 and 491 programs have been put on ice, until such time that State's do have a quota. As with most countries, COVID has also wreaked havoc on the economy and as Australia goes into recession with negative growth and unemployment approaching 10% the Government is trying to roll out policies very much focused on creating jobs for Australians. This leaves little place for foreign migrants at least for the short term and we expect that the migration program overall will be significantly reduced. The tide will inevitably turn at some stage. Australia cannot grow without migration. COVID-19 has put a speedbump in the way, but things hopefully will get back to some normality at some stage. It may, unfortunately, be the end of the line for those who are now approaching 45 given the delays. For others that still have several years before turning 45, I encourage you to use this time of uncertainty to get your documentation in order. 22.01.2022 Actual Migration Planning numbers have been published. GSM is slightly better than I anticipated but still down by a significant 57%, the Parent visa application is even less than anticipation with only 4500 .

22.01.2022 Parent visa Queue dates The Department is issuing QUEUE dates for subclass 143 visas. The reason they have done this is that there is a cap on the number of visas they can approve each financial year. In order to manage the Family visa places in an orderly and equitable manner, a capping and queuing system is in place. This means all visa applications are assessed in date of lodgement order. If an application appears to satisfy the criteria for the grant of the visa, it is th...en allocated a ‘queue date’ and placed in a global queue. To ensure no applicants are disadvantaged, all applications are treated equally. We release applications from the queue for final processing according to queue date. The time you may have to wait for your application to be finally decided is not able to be estimated due to changing annual planning levels, the withdrawal of visa applications and visa refusals. Queue release dates As at September 2020, the Department has released for final processing: Contributory Parent visa applications with a queue date up to May 2016 Parent visa applications with a queue date up to August 2010 Aged Parent visa applications with a queue date up to May 2012

17.01.2022 Many people have been waiting in anticipation for something to come out of the much anticipated Federal budget. For me the most significant statement is the fact that Employer Sponsored, Global Talent, Business Innovation and Investment Program visas will be prioritised within the Skilled Stream. This does not necessarily bode well for points tested visas where we have seen the trends reduce over the last year. What we have established Is that the overall planning ceiling f...or the migration programme will be will remain as previous year. That may appear positive however the underlying components that make up the planned migration numbers appear to be changing . the programme is now to have a strong focus on attracting the best and brightest of migrants around the world and it says tripled the global talent independent programme allocation for the coming year as anticipated the business skilled visas programme will remain important in a post COVID19 economy and allocation will be increased in this category as well A greater emphasis has also been placed on onshore family stream The streams that will be impacted over the next year will be General Skilled Migration and Parent visas. Our analysis shows that the Our estimates show that General Skilled Migration Program i.e. Skilled independent, Regional and State Nominated will reduce from around 66ooo places to 10000. Parent visas are expected to reduce by approximately 40% or 2000 visas, this will significantly impact processing times of parent visas going forward. So what does that mean if you are offshore. Points tested visas will become much harder to obtain and parent visas processing times will increase significantly. Focus going forward need to be on Employer nominated visas. At this stage we do not know what the skilled occupation lists will look like but expect that the occupations will be focused on post Covid recovery sectors. Other keys points from the budget are Australia’s net overseas migration is set to fall into negative levels for the first time since World War II with a loss of 72,000 people forecast for the 2020-21 financial year. Net overseas migration will not return to positive levels until 2022-23. The country’s population growth will drop to just 0.2 per cent this year, the lowest rate in more than 100 years due to international border closures and a slowed fertility rate.

15.01.2022 The last few months have been unsettling for us all. It’s taken an event such a global pandemic for many to reach the decision that they have to immigrate for the sake of their family. Then, there are others that are well advanced in the process, and all they want is for their visas to be issued. Others still need to get invited or get a job offer to make their migration dream real. The travel ban has also split families apart who may already have visas, already settled have... lives in Australia, leases, expenses but because they happened to have travelled overseas in March, are now separated from their family; and then those who were all packed up but never managed to get their flight out and are living out of suitcases, no job , no home etc. As an agent, I am continually fielding questions relating to all of these situations. Unfortunately, there are some realities we all need to face, and that is the goalposts have shifted at this stage we do not know all the answers, we can make informed assessments, but unfortunately, we don’t know when the travel ban will be lifted, we don’t know when you will get an invite or when we you will get your visa. It may be tough for awhile but if you have you mind set on migrating or getting your permanent residence if already in Australian take advantage of this time and get yourself in the best position to do so.

Unfortunately the picture is not pretty for those migrants who do rely heavily on the GSM and Parent visa programs.

08.01.2022 Travel exemption requirements for individuals in critical sectors or with critical skills The Commissioner of the Australian Border Force may grant an individual exemption if you are a non-citizen: - travelling at the invitation of the Australian Government or a state or territory government authority for the purpose of assisting in the COVID-19 response... - providing critical or specialist medical services, including air ambulance, medical evacuations and delivering critical medical supplies - with critical skills required to maintain the supply of essential goods and services (such as in medical technology, critical infrastructure, telecommunications, engineering and mining, supply chain logistics, agricultural technology, food production, and the maritime industry) - delivering services in sectors critical to Australia’s economic recovery (such as financial technology, large scale manufacturing, film and television production and emerging technology), where no Australian worker is available - whose entry would otherwise be in Australia's national interest, supported by the Australian Government or a state or territory government authority. An individual can submit a request for a travel exemption under this category or a business can submit a request on their behalf. The applications of multiple travellers within the same group/business can be linked, so that the requests are considered together.
