24.01.2022 COURT CLOSURE UPDATE: Due to the COVID-19 situation the effect on Courts continues to change as new directions are made by the relevant authorities. We are currently aware of the following:- Family Court and Federal Circuit Court Cases: All Court appearances for call over and duty lists are being conducted by telephone. ... Non-urgent or property only type matters may be adjourned to a future Court date. Some Trials will be adjourned, and others will proceed according to the decision of the Court as follows: 1. Firstly, the trial may proceed by phone; 2. Secondly, the trial may proceed on the papers with written submissions; and 3. Thirdly, the trial may proceed in person. Magistrates Court Appearances: An Ipswich Magistrates Court Guideline has issued. Each other Magistrates Court may have different guidelines. Many matters for callover will be conducted on the papers, without personal or telephone appearances required from legal representatives or defendants, with matters adjourned for three months from the date of listing. Matters listed for hearing will be adjourned unless otherwise ordered by the Court. IMPORTANT: The guidelines are quite complicated in respect of Magistrates Courts Appearances, so definitely seek the advice of your lawyer or contact the Court to confirm the situation regarding your Court appearance. The Courts are considering matters on a case by case basis, so you should contact your lawyer or the Court to confirm your situation.

24.01.2022 As everyone is, we are monitoring the situation regarding COVID-19. At this point there has been no direction regarding the closure of Courts, however we will update on any further news as it occurs. For current purposes we suggest all clients assume their Court dates and obligations remain current, until any further notice. Currently we are making appointments in a face to face setting subject to some screening questions. We are more than happy to make telephone or video c...onferencing appointments if preferred. We will be following the guidelines and measures implemented by the government and medical advisories in a way that we remain committed to providing ongoing services in this uncertain time. 05.01.2022 Covid-19 Court Update: From 15 June 2020 the Magistrates Courts will now operate with parties appearing in person with physical distancing to apply and hearings at intervals over the course of the day. Parties may apply for leave to appear by telephone or video as soon as possible but at least 2 days prior to the Court date. For some types of Court appearances parties are able to appear by telephone or video unless required to appear in person, however as these arrangements are specific to the type of Court appearance, you should seek clarification on your particular circumstances. Please do not hesitate to contact us for advice on your Court matter.

03.01.2022 Court closure update: We have received notification that the Family Court and Federal Circuit Court have put in place urgent arrangements for COVID-19. At present the summary is:- - there is an 8 person maximum to be in any courtroom (not including Judge and support staff) - telephone appearances and evidence will be used where appropriate - court dates for non-urgent matters may be delisted or adjourned to a later date at the decision of the Judge... - the Court will inform parties if their case is adjourned Of course we will be informing our clients of any Court date changes effecting them.
