18.01.2022 BREAKING NEWS - HIGH COURT WIN OVER ACLAND COAL MINE Farmers and community members from Queensland's Darling Downs have won a significant victory in the High Co...urt, which today ordered a fresh Land Court hearing into the controversial New Acland coal mine expansion. Our client, the Oakey Coal Action Alliance, has been locked in an epic legal battle to defend some of the best farming land in Queensland from New Acland Coal’s stage 3 expansion of its thermal coal mine on the Darling Downs, in the state’s south east. Today the High Court ordered a fresh hearing over the mine in the Queensland Land Court. It also ordered that New Acland Coal pay OCAA’s legal costs of the High Court appeal, and struck out an earlier costs order of approximately $736,000 against OCAA. This is a welcome decision from the High Court today," said EDO Managing Lawyer Sean Ryan. Our client and the other objectors can now look forward to the opportunity to present their evidence to a fresh Land Court of the impacts of this coal mine on the local farming area and on the rest of Queensland through climate change. 03.01.2022 While people have been focused on threats to the northern end of the Bylong Valley for years, there's now a whole NEW threat at the Valley's southern end. The n...orthern section of the two proposed new coal release areas of Hawkins and Rumker, north of Rylstone, extend to the southern end of the Bylong Valley. The dark solid green is mapped BSAL (Biophysical Strategic Agricultural Land), i.e. prime farming land. What are they thinking???? If a part of the Valley is worth protecting, then so is all of it. It's not a National Trust listed Heritage Landscape for nothing.



03.01.2022 Part of the Pilliga forest has now been closed so that Santos can conduct their gas mining operations - absolutely no social licence exists for this activity wh...ich is now centred on the Bibblewindi East field on Little Tighes Rd. Forestry Corp signage says Part Bibblewindi State Forest and part Pilliga East State Forest will be closed to the public for the exclusive use of Santos NSW Pty Limited period 20 October to 31 December 2020 (or as signposted). We only just found out about the closure despite it being backdated to 20 October. NSWGasBan are very concerned that Dewhurst 30 & 31 (sites that Santos have an existing approval to drill new CSG wells) could be within this closed area https://www.forestrycorporation.com.au//bibblewindi-east-s Clause 7 Reservation of forestry area for separate or exclusive use (1) The Corporation may, by displaying a notice to that effect in a conspicuous position in or in the immediate vicinity of a forestry area, reserve the area, for such periods as it thinks fit, for separate or exclusive use for any one or more of the following purposes: (a) recreational use and enjoyment, (b) enabling any person to exercise a right or privilege conferred by a licence, forest permit, forest lease or other authority issued or granted by the Corporation, (c) enabling any exercise or activity to be carried on by members of the Australian Defence Force, (d) enabling the Corporation to exercise any of its functions. (2) The Corporation may erect or authorise the erection of such enclosures, gates or ramps as it considers necessary for the purposes of such a reservation. (3) A person who, without the prior permission of the Corporation, enters or remains in an area set aside under this clause for separate or exclusive use is guilty of an offence. Maximum penalty: 20 penalty units. (4) A reference in this clause to the Corporation includes, in the case of a forestry area that is managed by a land manager other than the Corporation, a reference to that other land manager. clause 7 part (1) (b) is the relevant bit.
