21.01.2022 Whilst many people who have been or are in the Family Court system might consider the delay's in listing matters a burden, and the Court could be reasonably described as underfunded, it's Judicial Officers carry-out an important role in the best they can with what's available. We thank the Honourable Justice Thackray for His service and give his family and friends our condolences. From today's joint press release:... "The Honourable Stephen Thackray, the former Chief Judge of the Family Court of Western Australia, has passed away unexpectedly after suffering a brain aneurism. He was 65. Mr Thackray’s successor as Chief Judge, the Honourable Justice Gail Sutherland, said that he was a brilliant, astute and compassionate judge. Stephen led the court by quiet example, inspiring us all to want to do our best because we respected him, and liked him, and didn’t want to let him down. He cared deeply about the problems faced by separating families, and continually strived for new ways to better serve the public. We have lost a shining example, and a good friend. The Attorney General, the Honourable John Quigley MLA paid tribute to Mr Thackray’s outstanding contribution to the West Australian community in his 22 years of service as a judicial officer. Stephen Thackray led the development of family law jurisprudence throughout Australia to an extent matched by very few in the history of the Family Court, Mr Quigley said. He took on some of the most difficult cases ever to come before the court, and was universally respected for his open-mindedness, empathy and wisdom. Mr Thackray grew up in Mogumber, Western Australia, where many of his primary school classmates were part of the stolen generation. His concern for and affinity with indigenous peoples was instilled in his formative years, and continued throughout his professional career. Mr Thackray is survived by his wife Janet, his children Amanda and James, and his daughter- in-law, Leandri."

21.01.2022 With all of these fast-paced changes to our laws around the Covid-19 issue, please get in touch if you find yourself summonsed for allegedly breaking one (or more!) In some circumstances, where we think the law needs to be challenged, or if we consider your prosecution could be wrong or unjust, we will represent you pro-bono. https://mobile.abc.net.au//coronavirus-emergency/12114042

19.01.2022 Easter break restrictions for you to note: COVID-19 https://www.wa.gov.au//covid-19-coronavirus-regional-trave

16.01.2022 Some good information for parents with a child (or children) in a shared-care arrangement. Basically, keep-on with the current arrangements unless they are unworkable (i.e. if handover occurs at a contact service which is closed due to Covid-19 etc.); or if it is in the child/rens best interests not to (i.e. a parent has been diagnosed with Covid-19, the child/ren have a high risk of contracting the virus if they do spend time with the other parent etc.) Most importantly, a...s with most matters in shared-care arrangements, communication, negotiation and working together as best you can to find an acceptable solution is the most important thing to do if an issue caused by Covid-19 does arise! If you have any questions, feel free to get in touch with us on 08 6146 0086, send us a message or email to [email protected], or book a free appointment online at www.moanachambers.com.au/book.html http://www.familycourt.gov.au//connect/fcoaweb/about/news/

16.01.2022 Further to our post yesterday, we add that if there are parenting orders or similar in place that require you and your child/ren to travel across regions in WA to comply with them (i.e. transporting a child/ren from Perth to Kalgoorlie etc.), you should carry a copy of the orders or Parenting Plan in case you are required to show that your travel is authorised. Paragraph 4(g) of the relevant Directions provide that: "A person must not enter a region from another region except to the extent that...it is necessary for the person to do so for the purpose of fulfilling their obligations under a parenting plan, parenting order of a court or other parenting arrangement..."
