25.01.2022 Business Trips - China It was a fairly hectic nine day trip to China recently but as always very rewarding professionally and personally. I was fortunate enough to give a seminar on the Subclass 132 Business Talent and 188A Business Innovation Visas in four cities - Shanghai (pictured), Guangzhou, Shenzhen and ZhongShan - meeting new clients and building on my network of trusted partners in China. ... The sense of "Energy" in China never gets old and its always a humbling experience to meet clients who have been exceptionally successful but who's modestly belies their achievements. It is also remarkable to me that I get the opportunity to 'sell' Australia through the support of my partners and I thank them greatly for the opportunity to do so. But one thing struck me with great amusement on this trip. During my presentation, I introduced a building project to the audience. I was going through the project details, noting how it complied with visa requirements and so forth when the shear scale of Shanghai (and the rest of China for that matter) struck me. Here I was on the 30th floor of a 50 floor plus building looking out over the tallest city in China (and one of the great cities of the world) telling folks that a two level, 14 apartment project in Perth was a great deal ... (oh, it is a great deal btw) ... So as my smile grew I stopped the presentation and pointed out the window and we all had a laugh we where all thinking the same thing ... The rest of the presentation became a lot less formal as i did my best to assure everyone that tiny little projects are "OK" ... the difference in "scale" between life in China and Australia ... and what a difference it is. (P.S. I didn't get a photo of it but from the window to my left there was a new building under construction that made the comparison seem utterly absurd)

22.01.2022 Update for PhD holders Please be advised that as of 15 December 2018, VETASSESS will not accept doctoral studies supported only by living allowance and/or scholarships. Consistent with the Department of Home Affairs requirements, for skilled employment to be considered remunerated, applicants must be engaged in the occupation on a paid basis, generally at the award or market rate of the occupation. A person receiving minimal living allowances or scholarships designed to cover study expenses would not be considered to be remunerated. VETASSESS will continue to ensure that impact on its clients is minimised during the transition leading up to the implementation date. Applications received prior to 15 December 2018 will be processed according to the criteria at the time of applying.

21.01.2022 COVID-19 AUSTRALIA VISA UPDATE - 4 March 2020 The Acting Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs, the Hon Alan Tudge MP has announced a wide range of changes that effect temporary visa holders from Tourists to New Zealand citizens resident in Australia. There are some 2.17 Million Temporary Visa holders in Australia. The core changes and recommendation are: 1. Australia will extend no support to visitor visa holders and recommend th...at unless they have family support, they should return home at the earliest opportunity and even with family support shouldnt remain for an unnecessary amount of time. 2. International Students should rely on their families, part-time work and savings to support themselves. For longer term students, they will also be able to access their Superannuation whilst in Australia. Work rights beyond the 40 hours per fortnight have been extended beyond this for nurses and aged care student workers as well as those working in major supermarket chains, but the latter is a temporary situation. 3. New Zealand Citizens on 444 Visa are dually constituted. Eligible NZ Citizens will effectively be treated as Australian Permanent Residence and have access to welfare and Job Keeper payments. 444 Visa holder who have been in Australia for 10 years can access JobSeeker Payments for 6 months. All other 444 visa holders are being encouraged to return to New Zealand if they cant support themselves. 4. Temporary Skilled 457 and 482 Visa holders are better served to have been stood down rather than laid off. Temporary Visa holders can access their superannuation to a limit. They will not have access to JobKeeper or welfare payments. Where you are laid off, your visa conditions will come into effect and you will need to comply with those including leaving Australia where other options can not be found. 5. Working Holiday visa holders Subclass 4167 & 462 - will again receive no welfare support and must self-support if they are to remain in Australia. For those working in essential industries, working conditions have been modified to allow a longer duration than 6 months with an employer where employment is in a critical area. 10.01.2022 Minister Dutton has signed off on a lot of legislative changes in the last three months and he was at it again on 23 June 2017. In this instance, he implemented the Legislative Instrument IMMI 17/058. If your're not familiar with what a legislative instrument is, it can simply be described as 'pre-law direction' as it announces what the law will be subject to the normal review of Parliament (see more at: http://ags.gov.au/publications/legal-briefing/br103.pdf) However, lets ...get back to the point of this article. So, on 23 June 2017, the Minister released IMMI 17/058 which deals with occupations, skills and English requirements for Subclass 186 and 187 visas - Employer Nominated visas which are one of the biggest Skilled Visa classes we have. The value of the changes themselves can be debated later - trust me, the section on Genuine Need is a nasty piece of work. But, for now, its best you read Read Part 4 (abridged) and I have no doubt as fair minded people, you'll see the more important issue. Part 4 Application of this instrument (1) This instrument applies to applications for Subclass 186 and Subclass 187 visas made on or after 1 July 2017, and also to applications for Subclass 186 and Subclass 187 visas made before 1 July 2017 and not finally determined by that date. (2) '... to nominations under regulation 5.19 of the Regulations made on or after 1 July 2017, and also to nominations under regulation 5.19 of the Regulations made before 1 July 2017 and not finally determined by that date.' Yes ... oh yes ... the changes are Retrospective. So, this means that visa Nominations and Applications made under and compliant with the law prior to 23 June 2017 are now being assessed against rules made on 23 June 2017 - rules to which no one involved in the process had any knowledge off and as such, couldn't possible have prepared for their applications to meet "UNKNOWN" rules. Given that processing of 186 and 187 applications take somewhere between 9 to 12 months on average (we have quite a few which are now over 14 months old and without case officers), many applications will now be refused because they can't be compliant with rules that never existed at time the applications where made. Is this the New Aussie Fair Go?
