16.01.2022 The EU passed sweeping copyright reforms last week, ending safe harbour (meaning a provision of a statute or a regulation that specifies that certain conduct will be deemed not to violate a given rule) for YouTube. These reforms will force digital giants like YouTube "to negotiate fair license fees when their works are used by big online platforms", placing creators in a stronger position. The final bill passed will require UGC platforms like YouTube to agree "fair remunerati...on" license deals with rights holders and makes them legally liable for hosting unlicensed content, effectively ending safe harbor immunity (hip-hip-hooray!). All 27 EU members will have two years to legislate this directive into national law. It is unclear if the UK will adopt this directive as it leaves the EU, however, if a Brexit withdrawal agreement can be achieved (which is more than possible), its law will be applied throughout that transition period. According to Frances Moore, CEO of IFPI, "this world-first legislation confirms that User-Upload Content platforms perform an act of communication to the public and must either seek authorisation from rightsholders or ensure no unauthorised content is available on their platforms". This is a major win for music creators within the digital platforms.
