If Diego did a traditional job, he could ask for his job back - claiming unfair dismissal. But it's not clear whether the Fair Work Act applies to the gig economy. So Diego (and the @twuaus) are fighting a test case. It has big implications for the gig economy. I was pleased to join Diego last week on his first hearing day. Regardless of whether Diego wins its clear: Australia's laws need modernising. Your rights at work shouldn’t depend on whether you are called an 'employee.'

Every day of inaction puts more lives at risk. We need the State Government to act. We need modern workplace health and safety laws and a modernised workers compensation system.... No one ordering food through an app expects their rider to die on the job. Everyone who goes to work has the right to come home safe.
