07.01.2022 Appeals Panel Rules: No Pet By-laws are Valid. Everyone is talking about. Pets in strata. In what has been on interesting, ongoing set of cases in relation to by-laws, the Tribunal Internal Appeals Panel has ruled that a by-law which prohibits pets by way of a blanket ban (excepting of course service animals) is NOT harsh, unjust or oppressive. ... In a decision many were not expecting, the Panel has sided with the Owners Corporation. In its lengthy decision, which you can read here https://www.caselaw.nsw.gov.au/dec/1724e1ecfad345359d1fdf39 the members of the Appeal Panel explore the applied meaning of the ‘harsh, oppressive and unjust’ restrictions. This decision will impact not only matters related to pets, but any by-law where a case may be made that the by-law is in contradiction to s139 of the Strata Schemes Management Act 2015.
