21.01.2022 After having a win against the Public Trustee (as an executor of an estate) in the Brisbane District Court this week, I pass on this advice. If you know anyone who has the Public Trustee as their executor, know that the costs charged by the Public Trustee can, and should, be questioned and if not OK, challenged. Just because they are called the Public Trustee does not mean that the public must trust them without question. Absolutely question.

18.01.2022 18! Congratulations! Congratulations to everyone whose children have or are about to turn 18 and start their adult life. A great gift would be a Will! As soon as people turn 18, they should have a Will (and should update that Will every time something significant changes in their lives - babies, marriage, starting a business, divorce, death (not theirs obviously!!), buying property - the big stuff!). 17.01.2022 I recently saw a Will where the only executor nominated was a Government agency. The many downsides to this include their costs for administering the estate, the fact that they dont know where documents are so the family still have to go through everything and IF you can get them to renounce (to save the estate thousands of dollars), you also need to go to Court to have an alternate executor appointed. I strongly recommend: 1. select an Executor who knows where your thing...s are (the Executors job is just that - a job - not a gift!) 2. ALWAYS appoint an alternate Executor in case your first Executor cannot do the job for any reason 3. If you want to appoint a solicitor or a Government agent, make sure you know what that means for your estate when you die. How much will they charge? Do their policies mean that they are not open to options such as obtaining probate? 16.01.2022 If you die without a Will, it costs more for your family to apply for Administration than it does to do your Will! Get your Will done and save your family further pain. I have included some details below: If you die without a Will, your family cant do anything with your assets (bank accounts, car, motorbike, house) until they apply to the Supreme Court for Letters of Administration (without a Will). The cost just for filing the application is currently $659.70. The costs ...are revised annually, as are all Qld Government costs (and they only ever go up they never get cheaper!) Your family also has to advertise either in a Qld wide paper or a paper approved for the area of where you lived. They have to prepare documents or get a solicitor to prepare documents. It doesnt matter how much you own it could be very little and your family still have to incur these costs and go through processes. The Supreme Court website (http://www.courts.qld.gov.au//wills-a/applying-for-a-grant) states: Your costs may include: advertising fees court filing fees postage the fee for the original death certificate issued by the Registrar General payment for document preparation the solicitors fees (if you have engaged one). Advertising fees vary, so you should contact the relevant newspaper about its charges. So if you think about costs (and we all have to because we all have commitments and budgets), it is much wiser and much more economical to have your Will prepared and not die intestate. I have always said that an estimate for a Will is the same as quoting for a house to be painted - you need to know how big the house is, if the old paint needs to be stripped back, what sort of paint do you want to be applied? If you pay for a cheap paint job, you will end up with cracks in the paintwo...rk. If you get the right person for your job, someone who wouldnt put their name to shoddy work, you will get a result that doesnt have cracks. Its the same with estate planning - I would never want to put my name to something that results in cracks in your estate planning (your death planning (wills etc) and life planning - EPOAs). 06.01.2022 Great information - and from the Department of Natural Resources in their titles manual: "Care of Original Will Original wills must be treated with extreme care. It is essential that no marks or holes are made in an original will. No pencil notes should be made on an original will, nor should any ‘post it’ note stickers be attached to an original will, nor should any pins or staples be added to or removed from an original will. An original will should not be stapled to the application. The reason for this degree of care is that any attachment to a will, or any evidence of an attachment having been made to a will, may raise the presumption that a further testamentary document made by the testator had been attached by or at the direction of the testator, thereby altering the terms of the will."

02.01.2022 4 weeks to get an original Will from Public Trust Qld. If you have had your Will done for "free" (and it is never free - there is ALWAYS some payment from someone, whether that be money, poor service, long delays, frustration etc - free is NOT free) and if your original Will is with the Qld Public Trustee (Public Trust Qld) this is just the time frame to obtain the original Will to be able to start the work for the estate! If your original will is with the Public Trust, ask your executors (if you have been smart enough not to appoint the Public Trust Qld) whether having your Will with Public Trust creates yet another job, delay and problem for them. If it does, I strongly recommend that you get your original Will from Public Trust Qld.

01.01.2022 Did your young people turn 18 this year? Do they have a Will? Do they have a Power of Attorney? Without a Will the court costs are huge just to get authority to close a bank account. Without a Power of Attorney who has authority to speak with the doctor for them? They are adults now and unless they have a spouse (for the statutory power of attorney) they wont have anyone to talk for them.
