25.01.2022 Violent fathers will be deported from Australia: Under a new directive issued by the Federal government, foreigners convicted of family violence against will be departed from Australia or banned from entering Australia. This new directive will also apply to the Administrative Appeals Tribunal meaning there would be no review of a visa cancelation decision under the directive. Current laws only allow the government to revoke visas of foreigners who fail a character test or who have spent 12 months in jail.



25.01.2022 Australian permanent residency - 117 occupations open for skilled migrants willing to migrate to Northern Territory: Over the next five years, low skilled migrants with limited English will have the option to apply for permanent residency after living and working in the Northern Territory for at least three years.... From cooks to family day care workers to motor mechanics, low skilled migrants will now be able to apply for Australia’s permanent residency. Northern Territory has opened its door to skilled migrants in 117 occupations and has offered a pathway to permanent residency to these workers who are willing to work and live in the region for at least three years. In a bid to distribute the migrant population outside Australia’s major cities such as Sydney and Melbourne, the Australian government has designed a new scheme to attract migrants to regional areas across the country. The scheme - known as the Designation Area Migration Agreements (DAMA)s has been announced for two regions in Australia - Warrnambool region in Victoria and the Northern Territory which are experiencing labour shortages and need a population boost. The second-such agreement for NT, this time with a pathway to permanent residency, DAMA II came into effect on January 1st 2019. 23.01.2022 Proposed Changes to Character Test: The government has introduced a new bill which, if passed by the Parliament, will amend section 501 of the Migration Act. The changes will ensure that a person will not pass the character test if they have been convicted of an offence which carries a maximum sentence of at least two years. It is pertinent to note that the person does not need to have been sentenced, only convicted of an offence. Offences include violence against a person ... including murder, manslaughter, kidnapping, assault, aggravated burglary and the threat of violence plus non-consensual conduct of a sexual nature, using or possessing a weapon and breaching an order made by a court for the personal protection of another person. Opposition home affairs spokeswoman Kristina Keneally has demanded the following three changes - that the test not apply retrospectively, that a person must be sentenced to at least 12 months in jail before being captured by the new regime and that ministerial discretion for New Zealanders be reviewed - before supporting the tougher character test. Since 2014 more than 4700 visas have been cancelled on character grounds. It is expected that the new character test will lead to an increase in visa cancellations.

In order to participate in a SISA event, you must first be endorsed by the South Australian Government (Department for Trade, Tourism and Investment) and then apply to the Department of Home Affairs for a Temporary Activity (subclass 408) visa, in the Australian Government Endorsed Event stream. How long will the visa be? SISA will run for three years, commencing November 2018 and ending November 2021. However, the length of your visa will be dependent on when the visa is granted. If, for example, you are granted a visa on November 2018, your visa will end in November 2021, making it three years. But, if you are granted a visa in June 2019, your visa will still end on November 2021, making it two years and five months. If sufficient convincing evidence is not provided in relation of all four aspects of the relationship, the chances are that an application would be refused for not being genuine.

13.01.2022 Five- Important Changes in Australian Migration Law In 2019: 1. Longer processing times for partner visas: Since the Family Violence Bill passed in the Senate in November 2018, partner visa sponsorships need to be approved first before applications are lodged. This means that potential offshore applicants and sponsors will have to pass through a stringent process to assess their character and history. This will prolong the process of obtaining a partner visa.... 2. An introduction of a new temporary sponsored parent visa: This year, Australian citizens and permanent residents will be able to bring their parents from overseas to Australia. Parents of Australian permanent residents and citizens can stay temporarily in Australia for either 3 or 5 years. Only 15,000 visas will be granted each year. Once approved, these parent visas will be valid for three or five years, costing $5,000 and $10,000 respectively. The said visas are renewable, but only up to a maximum of 10 years when combined. 3. An increase in show money for foreign students to more than $20,000: This year, international students have to be able to provide evidence of funds of around $20,290. Bringing in a partner is an additional $7,100 and an additional $3,040 needs to be provided for each child. 4. Matching ATO tax records to salaries of employer-sponsored migrants: The Department of Home Affairs and ATO will make sure employer-sponsored migrants are paid what they are due. This year, the Department of Home Affairs will be cracking down on companies underpaying employer-sponsored migrants. In partnership with the ATO, the department will be gathering the tax file numbers of those who currently hold a 457/482 TSS visa in order to match them with current tax records to make sure that the said migrants are being paid the right amount based on their nominated salary. 5. South Australia visa for start-up entrepreneurs: South Australia will pilot a program in 2019 for start-up owners who want to migrate to Australia. The state is set to pilot a new visa for start-up entrepreneurs which isn’t as difficult to obtain as a Business and Innovation visa. The said visa doesn’t require a $200,000 funding arrangement and only a 5 average band score on the IELTS. The Federal Government has recently signed a revised DAMA with the Northern Territory that provides visa holders with a pathway to permanent residency. The same agreement has also been announced for the Great South Coast region of Victoria and it's currently under discussion for the Orana region in NSW and Cairns in Queensland.
