25.01.2022 On Thursday the 19th of December 2019 the Council Assessment Panel approved Development Plan 674/0147/19 for the Naracoorte TAFE campus to be used for short term workers accommodation, despite heavy opposition from the community. The decision will now be appealed to the Environment, Resources & Development court in an action by local residents. This page will be a source of information and appeal updates for the wider community and a link to the TAFE Campus Appeal Fund GoFund...Me page, to raise funds for legal representation. This is a development that will negatively impact upon our whole town and if you support the fight to stop it, we need your financial help. Funds will be used to retain solicitors and engage planning experts to give us the best chance we have to win an appeal. We proceed with hope that the campus may be developed in any number of ways that are appropriate for the location and benefit the wider community. 25.01.2022 On Monday Council provided a statement regarding the TAFE campus. Our solicitor attended the ERD Court on the 1st of April, for a Directions hearing, to appeal the Change of Land Use to ‘Temporary (Short Term Workers) Accommodation' at 19 Gordon St. At this hearing the developers requested a second adjournment of the appeal, ... ‘due to the current health situation and the viability of the project'. The next day, being the 2nd of April the developers strategically lodged two new applications, for 'Buildings 4 and 6'. The application was now for a change in land use to ‘multiple dwellings’, rather than ‘workers accommodation’. The plan for 'Building 6' sees 9 people share 5 double beds. The plan for 'Building 4' sees 6 people share 3 double beds. The occupants can still be expected to be short term workers, as eluded to by Trevor Smart 'whether the occupants are workers or not...the development falls within the definition of a multiple dwelling' - The News article, 13/5/2020. An application for ‘multiple dwellings’ can be classed by council as a category 1 development, and therefore can be approved without community consultation. The Council has approved these applications separately and without regard for the current appeal proceedings before the ERD. 19.01.2022 A Preliminary Conference was held on Monday the 10th of February in the Environmental Resources and Development Court. This hearing was to provide an understanding of the matter to the Court. We will now reconvene for a Directional Hearing in the first week of March. At this hearing we will be provided a timeline from the Court of how the appeal will proceed and when a full hearing will be set down for / heard. ... They can choose to side with the Developer - supporting them in their fight against the appeal and spend rate payers money in doing so ... 2. Acknowledge our communities views and be represented but not actively defend against the appeal, essentially leaving the Developers to fight the appeal on their own
