Good afternoon, Good news regarding the very large reduction in coronavirus numbers in Australia, particularly compared to most places worldwide.... The timing is good with summer approaching which not only restricts additional cases but provides a positive buoyancy within the public, and leading to an increase in drycleaning volume! One of the challenges of a national organization is keeping track of individual state’s regulation changes as you can see below with the dates for extension of Commercial Rent Relief. In discussion with members a number are having difficulty with Landlords and Agents demanding payment of rent as stipulated in the lease following the initial date of September. However there are also many members who have negotiated a satisfactory rental arrangement. Just to recap the eligibility requirements for the national code of leasing: Eligible for JobKeeper Example : If sales down 80% then rent payable is 20%, with 40% being waived and 40% being deferred payable over the term of the lease or 24 months. Mediation is an option where agreement is not possible via the Small Business Commission or the equivalent in each State. For example mediation is free in Victoria, but incurs a charge in SA and NSW. Extension of the Code for SME Commercial Leasing vary from 31st December to 28th March when JobKeeper 2 is planned to end. We will be advocating to Queensland and Victoria to change the date of 31st December to 28th March in line with the other states. In cases where there is no co-operation from the Landlord, personally I like the approach as outlined by Victoria where you pay what you can afford and apply for mediation. In some cases this is sufficient to get the Landlord to co-operate. The Vic email is attached outlining the process with a direct link below. Where you currently don’t qualify for JobKeeper you are not covered by the Code. I have listed dates for each State with a link to the appropriate section of the website. We need to be planning for the time when government incentives are no longer available and costs such as finance and lease benefits have been withdrawn. Keep negotiating, we don’t know what the government has in mind after March 2021, banks will do deals, and good landlords will structure payments for gold plated tenants.
