24.01.2022 Recent WHS Legal Cases: Unsafe work systems costs PCBU $1.3m in damages A worker with serious strain and lifting injuries has been awarded $1.3 million in damages, with a court finding his employer could have prevented the risks through simple precautions, including one involving a $400 spend. In 2017, he sustained a lower back injury when he and three other workers replacing a switchboard at Canberra Airport were required to manually lift the 400kg device. The following year..., he injured his left hip working with an awkward posture on top of a 2.5-metre-tall switchboard. PCBU's fine increased to $300,000 for failure to act on fatal risk A PCBU's WHS fine over a worker's death in a fall has been increased four-fold to $300,000, with an appeals court finding the fatal risk would have been obvious from a single "glance" at the relevant work area, and the PCBU's safety personnel failed to take steps to reduce the risk despite discussing it in meetings. The company failed to cover or take other precautions to prevent workers from falling after cutting 16 penetrations in the roof of an enclosure room in breach of a 21-page Safe Work Method Statement. After workers had been working on the roof for six days prior, a worker on the roof fell through one of the penetrations and sustained traumatic brain injuries when he landed on the concrete floor 4 metres below. In resentencing the PCBU the court noted that the PCBUs engineering manager was present when the penetrations were cut and knew they hadn't been covered, and this safety issue was discussed at daily toolbox meetings of employees involved in the project. But despite these discussions, "no method of reducing the risk was formally specified by any person in the organisation who held a position of responsibility for safety, either orally or in writing", they said.

Division 4 Emergency plans Section 43 Duty to prepare, maintain and implement emergency plan (1) A person conducting a business or undertaking at a workplace must ensure that an emergency plan is prepared for the workplace, that provides for the following (a) emergency procedures, including (i) an effective response to an emergency; and (ii) evacuation procedures; and (iii) notifying emergency service organisations at the earliest opportunity; and (iv) medical treatment and assistance; and (v) effective communication between the person authorised by the person conducting the business or undertaking to coordinate the emergency response and all persons at the workplace; (b) testing of the emergency procedures, including the frequency of testing; (c) information, training and instruction to relevant workers in relation to implementing the emergency procedures. On 13 August 2020, the High Court handed down a decision about the method of accruing and taking paid personal/carer’s leave under the National Employment Standards. ...
