16.01.2022 Illegal felling Giant redwood & nearby ancient woodland, written legal decision by District Judge Thomas made on 24th September I received this written decision... via Swansea Council. As it is over 15 pages long, I just reproduce the conclusion. As you can see it is pretty damning of Mr Sauro and his company! Sentencing is listed for 15th October. Conclusion The basic proposition is that a swathe of trees including a heritage tree are cut down contrary to tree preservation orders to the contrary. In order to prevent this happening very stringent plans were made, there is a detailed plan referred to as AW7 and written detailed plan for the method of protecting the trees that were to be protected and safely taking down the others. I was satisfied that if anyone including the defendants looked at the plan they would know what they could and could not do I was satisfied that although the plan was not displayed each of the defendants, their servants or agents knew precisely what they could and could not do. I don’t think the defendants can have it both ways. Since 2016, the issue of how to deal with the trees has received great prominence in the plans and the giant redwood because of its characteristics would have been obviously subject to protection. In any event it was not on land the defendants were authorised either by planning or the owners to work on. So, if the defendants and Mr Anderson actually know what their obligations are what basis could be for there to say the cutting of the trees was a mistake? I remind myself that the plan is simple and robust. There is no room for misunderstanding. When arriving at the foot of the Giant redwood the only thing Mr Morgan could think is that this is the giant redwood on the plan and has a TPO. Dealing with the giant redwood and the ancient woodland together I remind myself that they were taken down by a competent and experienced contractor, that the company cleared the site and most of the wood was taken away on lorries. The defence says it was accidentally done when Mr Morgan became disorientated. This is such an unlikely scenario that it can be safely discounted. It is not possible in my view for a man to cut down 72 trees accidentally on land not owned by his employer and in an area where they should not have been and where there was a 2-metre-high fence. There would be no basis upon which I conclude that Mr Morgan would exceed his responsibility and start to cut trees he must himself know were protected. His admission that he did so under instructions fits the facts very well and is the explanation I accept. What that means explicitly is that a positive decision was made to ignore the tree plan and it is the opposite of accidental. It is deliberate. I am also satisfied that those instructions would come from the first and second defendants and that there would have been discussions about how it was to be done, permission obtained to remove the fence and any other preparatory work. I am further satisfied that these instructions would not have been generated by Mr Anderson himself, they are beyond his authority. He would himself have been told what to do by Mr Sauro in his own capacity and as the director of the defendant company. I make no finding about whether Mr Sauro was physically present when Mr Morgan was told what to do but the second and third defendant have been friends since school and given that Mr Morgan says he acted on instructions I would be extremely surprised if he did not confirm them with Mr Sauro. It matters not however whether the instructions were given to Mr Morgan directly by Mr Sauro and passed on by Mr Anderson, the trees were caused to be felled by those instructions Accordingly, I make a finding of fact that Mr Sauro caused the destruction of these trees in the most obvious way: namely by directing they should be felled. The company Enzo Homes Ltd employed the 3rd defendant and the site foreman. They were conducting the works on the site through both these people and gave Mr Morgan assistance to do the work. It is impossible to conclude they would not know what he was doing they organised things and that includes the unlawful taking down of trees. They are certainly liable. On the facts of this case I am driven to the conclusion that this could only have taken place on the instructions of the first two defendants. This is a deliberate planned breach of the tree preservation order and in defiance of it. I will deal with the issue of relative culpabilities after mitigation and in the course of sentencing. Lastly, it follows that there is no substance in the suggestion that Mr Morgan was on a frolic of his own, nor that the culpability lies with Mr Lecoq.

12.01.2022 Naturaculture a for profit Arboricultural business that specialises in working for not-for-profit Social Justice organisations seeks an Arboricultural Consultan...t to work with our team in Vanuatu. We are seeking a full time consulting level arboriculturist with the capacity to be trained to work at a senior level, though will take a senior level consultant who ticks our boxes. The successful candidate is to be a team player that practises inclusivity for all staff, our preferred consultant is to be more interested in giving than receiving, though we will provide a healthy remuneration package to the right candidate as well as professional development opportunity. Our team is made up of highly experienced arboricultural managers, consultants and contractors run by a Director and Executive Officer. Our project is unique in that we are setting up a soil food-web grade commercial compost facility (with the Soil Food-web Institute Australia), your role will involve co-managing a range of diverse arboricultural initiatives involving the compost facility, a veteran/ancient tree management program, re-vegetation of mining sites, plant nutrient analysis, as well as assisting with staff mentoring & training. Your role is fundamental to our joint progress, so we need a very sharp mind. Selection criteria - Minimum Level 5 Diploma in Arboriculture preference to Level 8 Graduate Diploma in Arboriculture (or UK equivalent) applicants. Certificate 4 in Training & Assessment (or UK equivalent) is an attractive addition to your application. QTRA or VALID certified with demonstrated risk assessment experience (or other UK equivalent). Minimum 5 years consulting experience post graduation. Minimum 5 years contractual experience must be fit enough to assist contractual staff with field work & cyclone response work, as well as be capable of carrying out aerial climbing inspections on ancient/veteran trees. Ability to apply academic knowledge and concepts to practical situations. Experience of AutoCAD software systems, or equivalent. Excellent report writing skills. Solid botanical skills for identifying vegetation. Experience in identifying organisms with a predisposition to impact on tree vitality or tree biomechanics. Experience in large-scale tree planting or re-vegetation projects. Proven ability to carry out planning, research & to network. Proven ability to assess & hypothesise on tree body language in the context of VTA. Laboratory experience is a benefit (training will be given). High level of personal & professional integrity. Willingness to commit to up to 5 years with a base in Vanuatu & a willingness to participate in Australian/UK projects. Commitment to participate in Naturaculture security program. Commitment to follow staff code of conduct. Drivers license essential, MR truck license attractive to have. Project start due September/October 2018, our full time consultant will be needed to join us soon after our depot is established.
